Guest House Covenant.DOC GUEST HOUSE COVENANT Property Address: 806 Cary Road (also on same site is 812, 816, and 818 Cary Road) Edmonds, Washington Assessor’s Parcel Number: Legal Description: I, the undersigned, acknowledge that the above described property is one legal lot, and that under current City of Edmonds (“City”) requirements for single-family residential zones, only one single-family dwelling unit may be constructed per lot. I further acknowledge that in order to construct a new single-family dwelling unit on the property, I must either remove the existing single-family dwelling unit from the property or convert it into a guest house as defined in section 21.35.030 of the Edmonds Community Development Code (“ECDC”). I hereby agree to convert the existing single-family dwelling unit on the above described property to a guest house, as defined in ECDC 21.35.030, prior to the City granting final occupancy on a new single-family dwelling unit on the property. Once converted to a guest house, I agree to maintain the existing single-family dwelling unit as a guest house in accordance with the City’s requirements for guest houses, unless conditions are satisfied to allow for subdivision of the lot or the City otherwise amends its code to allow an additional single-family dwelling unit on the property. I agree and understand that it is my responsibility to notify all future property owners or long- term lessors of the existence of the guest house and limitations on use of and facilities in the guest house. I agree and acknowledge, on behalf of myself, my heirs, successors, and assigns, that if any conditions of this covenant are violated, the property owner will be required to complete the conversion of the existing single-family dwelling unit to a guest house as defined in ECDC 21.35.030 if not yet completed and, if applicable, to restore the same to a guest house if it is later improved, modified, or altered in violation of this Covenant. This Covenant shall be recorded with Snohomish County, shall run with the land described herein and shall be binding upon the undersigned, their heirs, successors and assigns.
