HONE AX WWWEDMONDSWAGOV OVERFLOW/FLOODING HOLD HARMLESS AGREEMENT This overflow/flooding hold harmless agreement (“Agreement”) is made by and between the City of Edmonds, a Washington municipal corporation (the “City”),and Mike and Chrystal Lanning (the “Property Owner”). WHEREAS, the Property Owner owns the property located at 396 Sunset Ave N in Edmonds, Washington; and WHEREAS, the Property Owner is undertaking a single family residence project at that address, whichinvolves the installation of a pump system for stormwater management; and WHEREAS, the project does not have a natural discharge location, infiltration is infeasible, and the only stormwater solution is the installation of a stormwater pump; and WHEREAS, a City Public Works Department/Engineering Division policy relating to the use of pumping systems for the conveyance of stormwater on private property states that an overflow/flooding hold harmless agreement may be required at the discretion of the City Engineer or designee; and WHEREAS, the City Engineer has determined that an overflow/flooding hold harmless agreement is appropriate for the Property Owner’s project; NOW, THEREFORE, the parties hereto agree as follows: 1.The Property Owner expressly agrees to hold harmless and indemnify the City, its officers, agents and employees from any and all claims, injuries, liabilities, losses, damages,demands or suits at law or equity, including costs and reasonable attorneys’ fees for defense of the same that the City may suffer as a result of claims,injuries, liabilities, losses, or damages to any and all persons or property, costs, or judgments against the City which result from, arise out of, or are in any way connected with the Property Owner’s acts, errors or omissions in the installation and use of the stormwater pump and any resulting overflow and/or flooding that results therefrom. This expressly includes any and all claims by agents, contractors, subcontractors, invitees, and assignees of the Property Owner. 2.The undersigned, by their signatures, verify that they have the authority to enter into this Agreement on behalf of their respective party.
