S.W., Edmonds, WA. 98026 Dear Mr. Kanczugowski, The City received a complaint regarding a commercial vehicle over 10,000 pounds gross weight in a residential zone and the possibility of a business at this location. It was noted that a commercial truck with a 12,000 pound gross weight was parked in the City right-of-way along 238''. If the truck and other commercial vehicles at the property are related to a business at this address, a home occupation permit is required. Commercial vehicles in residential zones are regulated in the Edmonds Community Development Code (ECDC) as follows: ECDC 17.50.100.A Commercial vehicle regulations (in residential zones). No person shall park or store more than one commercial vehicle or any commercial vehicle over 10,000 pounds licensed gross vehicle weight per dwelling unit on any lot in any R zoned district unless he/she has first obtained a conditional use permit. For the purposes of this section, "commercial vehicle" means any motor vehicle, the principal use of which is the transportation of commodities, merchandise, produce, freight, vehicles, animals, passengers for hire, or which is used primarily in construction or farming, including but not limited to bulldozers, backhoes, tractors and cranes. ECDC 8.48.180 Overnight parking prohibited in residential areas. It is unlawful and a violation of the traffic code to park or otherwise leave overnight, or between the hours of one minute after 12:00 midnight and 6:00 a.m., on any street or highway in the city of Edmonds within or abutting an area classified as residential (RS, RD, RML, or RMH) or open space (OS) by the official zoning ordinance the following types of trailers and/or vehicles: A. All types of trailers designed to be drawn by a motor vehicle including but not limited to boat trailers, trailer homes and mobile homes; and B. Vehicles over 10,000 pounds licensed gross vehicle weight, the principal use of which is the transportation of commodities, merchandise, produce, freight, animals, vehicles, passengers for hire, or which are used primarily in construction or farming, including but not limited to bulldozers, backhoes, tractors and cranes. It is not necessary that restricted parking or other traffic signs be erected for the purpose of enforcing this section. [Ord. 3564 § 19 2005]. 23811 77 h P1. W., ZE-07-255, COD20070091, Kanczugowski The 12,000 pound gross weight vehicle requires a conditional use permit to park in a residential zone. Additionally, it can not be on the street or right-of-way between midnight and 6:00 a.m.. Home occupations are a permitted use in residential zones but do require a business license and home occupation permit. There are seven criteria that must be met to obtain an administrative home occupation permit. If a home occupation proposal doesn't meet one or more of the criteria the property owner may apply for a conditional use permit. There is no guarantee a conditional use permit will be granted if an application is submitted. A Home Occupation handout is enclosed. Corrective actions required: • Please contact me by October 10, 2007 to respond to the information above. An Order to Correct is issued if contact is not made. • If the resident is interested in running a commercial business at that location, please make a full application for a City of Edmonds business license and home occupation permit by October 31, 2007. • The commercial truck (Plate A16367F or B22301C) needs to be removed from the residential zone by October 15, 2007.
