A building permit is also required for accessory structures over 120 square feet. The City shows no records for a building permit for an accessory structure at this address. The subject property is in the RS-10 Zone which requires a 10 foot side yard setback (a corner lot has two street setbacks and two side setbacks with no rear setback). Eaves may project into the required setback not more than 30 inches. In order to be in compliance, the accessory building will need to obtain a building permit and be out of any required setbacks. The permit application would need to substantiate that the building is either moved or reduced in size to accommodate the setback. Corrective actions required: • Please contact me at your earliest convenience by February 28, 2008 to confirm receipt of this information and to review the corrective actions. If you have any records showing the structure was permitted, please forward this information. • Please submit a complete application and fees for a building permit by March 20, 2008. A handout is enclosed regarding accessory buildings. Or; • If you prefer to reduce the size of the accessory structure to 120 square feet or less and meet setbacks, a building permit is not required. A compliance inspection would be required. • Another option is to apply for a variance.
