Memo to street file re_deck replacement.docMEMORANDUM Date: July 2, 2007 To: Street File From: Mike Clugston, Planner Subject: Deck replacement in street setback During the review of the Willcock deck replacement at 918 Sea Vista Place (BLD20070576), it was noticed that the deck appeared to be constructed so as to protrude 3 feet into the 25-foot street setback (site plan received May 25, 2007). The original site plan from Homeland Homes was submitted as part of a building permit application for the construction of a single family house in 1986. It indicated that the deck was proposed to be constructed outside the 25-foot street setback (the dashed line) while the stairs proposed for the southern portion of the property were originally redlined. From that point, it was uncertain whether the deck was constructed to meet the setback criteria and then altered by a subsequent owner without a permit or if it was originally constructed improperly in the setback. In a letter from Cathy Willcock dated June 7, 2007, according to the original owners of the house, the deck is as it was originally built – no modifications had been made after its original construction. Because the decking, stairs and landing were proposed to be replaced and the footings were not going to be moved, the replacement was approved by Planning, recognizing the existing non-conformity. It is understood that if the footers were to be moved, the structure would have to be reconstructed to meet the street setback requirement. Discussed the review with Duane Bowman, Development Services Director, on July 2 and he concurred with Planning’s decision.
