Dear Michael,
I am in receipt of your April 22, 2013 letter requesting the 12-month period for
completion of the subject short plat improvements begin on the date you picked up the
civil construction plans from City offices on March 28, 2013.
The City accepted a performance bond on July 23, 2012 in the amount of $72,296.60 as
surety that all improvements required with development of the subject short plat would
be constructed by July 23, 2013. As the civil construction plans for the development
were just recently picked up, no work has begun at the site and no public health or safety
concerns exist at this time, the city will not demand payment of the bond at this time and
will allow you to move forward and begin construction of your project.
The City will continue to monitor the development and reserves the right to call the bond
should any health or safety concerns be presented or any other unforeseen condition that
requires immediate completion of the development. As requested, the City will expect
completion of the project on or before March 28, 2014.
