COMPLIANCE WITH ECDC CHAPTER 16.20 The purposes of the RS — Single -Family ROBIN HOOD DR Residential zone are to reserve and regulate \����G� areas primarily for family living in single- SO family dwellings and to provide for Q;. additional non-residential uses which complement and are compatible with single- ' �Q family dwelling use. Per ECDC 16.20.010, 1 PAP an ADU is an allowed secondary use with a conditional use permit. The proposal is required to comply with the purposes of the single-family residential zone and the criteria - in ECDC 20.21. Based on the review of the Ciry of Edmonds Zoning Map, December 2009 specific ADU criteria (as described in Section C of this report), staff feels that, with conditions, the proposal is in compliance with the purposes of the single-family zone. C. COMPLIANCE WITH ECDC CHAPTER 20.21 Section 20.21.030 of the Edmonds Community Development Code provides the criteria describing how an accessory dwelling unit is to be reviewed. In order for the permit to be approved, all of the Ogden ADU File No. PLN-2010-0074 Page 2 of 4 criteria must be met. The criteria for approval are as follows: (1) Land Use Permit; (2) Number of Units; (3) Size; (4) Location and Appearance; (5) Parking; (6) Occupancy; and (7) Safety, Light, Ventilation, Floor Area, and Similar Factors. The ADU criteria were established to ensure that accessory dwelling units would comply with Chapter 16.20. 1. Land Use Permit Required Per ECDC 20.21.030.A, a land use permit is required for approval of an accessory dwelling unit. An application for an administrative conditional use permit was submitted to the City on November 23, 2010 (Attachment 1). The application was determined to be complete on January 11, 2011 (Attachment 15). 2. Number of Units The proposal will result in only one (1) ADU. This is in compliance with the number of units allowed per ECDC 20.21.030.13. 3. Size The applicant has indicated that the ADU will be located in an approximately 420 square foot addition (Attachment 3). The Snohomish County Assessor identifies the existing residence as being approximately 1,776 square feet. As a result, the proposed ADU would comprise 24% of the total livable floor area of the primary dwelling. The following table describes both the maximum size that accessory dwelling units are allowed to be as well as the proposed dimensions for this application: Maximum Allowed Proposed 40% of livable area of the primary dwelling 24% of livable area of the primary dwelling 2 bedrooms 1 bedrooms 800 square feet 420 square feet 4. Location and Appearance According to Chapter 20.21.030.13 of the Edmonds Community Development Code: The single-family appearance and character of the residence shall be maintained when viewed from the surrounding neighborhood. The design of the accessory dwelling unit shall be Ogden ADU File No. PLN-2010-0074 Page 3 of 4 incorporated into the design of the principal dwelling emit and shall be designed to maintain the architectural design, style, appearance, and character of the main building as a single-family residence using matching materials, colors, window style, and roof design. The existing mid-century modern rambler sits on a residentially -landscaped parcel (Attachment 7). As indicated in Attachments 4 and 5, the proposed addition will be attached to the existing residence by a short breezeway off of the northern side of the house. The addition, a pre- fabricated design from Modern -Shed, appears to use materials that will match the existing construction in order to maintain the design, style, appearance and character of the main residence including a shed roof and wide open joint siding (Attachment 8). The ADU must share the electric and water meters of the existing house. 5. Parkin ECDC 20.21.030.E states that an accessory dwelling unit requires one (1) off-street parking space in addition to the parking spaces normally required for the principal dwelling. As a result, a total of three parking spaces are required for this proposal. According to the site plan submitted (Attachments 4 and 5), there is sufficient space on the site to park two vehicles in addition to the two -car garage associated with the existing residence. 6. Occupancy ECDC 20.21.030.F states the homeowner must provide an affidavit attesting to his/her occupancy of one of the units for a minimum of six months of each calendar year as a condition of approval. The applicant submitted the affidavit (Attachment 9). The applicant must also file the required Covenant with the County Auditor. 7. Safety, Light, Ventilation, Floor Area, and Similar Factors ECDC 20.21.030.G states that as a condition of approval, the applicant is required to apply for a Compliance Permit and inspection by a City Building Inspector to ensure that the accessory dwelling unit meets the requirements of all life -safety codes and standards. In this case, this compliance permit will take the form of a building permit for the residential addition. D. TECHNICAL REVIEW The Engineering and Building Divisions, the Departments of Public Works and Parks and Recreation, and Fire District #1 have reviewed the application. The Building Division (Attachment 12) noted that a building permit is required for the addition. E. PUBLIC COMMENTS No public comments were received. F. DECISION Based on statements of Fact, Conclusions, and Attachments in this report, the application for a Conditional Use Permit for an accessory dwelling unit at 10603 Robin Hood Drive is GRANTED, subject to the following conditions: 1. The Accessory Dwelling Unit Covenant must be filed with the Snohomish County Auditor prior to occupancy of the accessory dwelling unit. A copy of the auditor -endorsed document must then be submitted to the Edmonds Planning Division. Ogden ADU File No. PLN-2010-0074 Page 4 of 4 2. A building permit for the residential addition must be obtained from the Building Division and final inspection must be made and occupancy approval granted by the City Building Inspector prior to use of the new construction as an ADU. 3. This permit shall expire automatically if any of the following issues arise: a. The ADU is substantially altered and is thus no longer in conformance with the plans and drawings reviewed and approved by the permitting authority and building official. b. The subject site ceases to maintain the required number of parking spaces. c. The property owner ceases to reside in either the primary residence or the ADU, the owner - occupied unit is rented, or the current (or future) owner fails to file the affidavit required under ECDC 20.21.025.A.1. 4. The Accessory Dwelling Unit permit shall not be transferable to any site other than the subject site described in the application. The permit is transferable to new owners of the subject property unless there is a violation of any conditions of approval listed above; however, the new owners must file a new notarized Accessory Dwelling Unit Affidavit with the City of Edmonds Planning Division. Attachment 1 Revised on 9114110 B - Land Use AFplication Page I PLN-2010-0074 November 19, 2010 To Whom it May Concern, I am requesting approval to add an accessory dwelling to my residence at 10603 Robin Hood Drive in Edmonds. I am the sole owner. My intent is to build an addition on my existing single story, 1800 square foot, NW contemporary style house that is in a complimentary style. The lot is a corner lot and .26 acres. I have a large, flat, back yard that make a perfect site for the accessory dwelling unit. Please see the adjoining photos which I hope will show how the style of the main house blends well with the style of the proposed ADU. The purpose of this accessory dwelling unit is threefold: ® First, to provide the possibility of rental income during my retirement years, which may allow me to stay in my home longer than I could afford otherwise. ® Second, to provide a space for my son to live in independently through his college years, as this would greatly reduce my costs for college housing. He plans to be a doctor so I am in for many years of additional education and housing costs. ® Third, to have the option to have one of my four sisters live with me, but still be independent, in our retirement years. Along with that would come increased security and companionship for both of us, gained by having the opportunity to create this accessory dwelling unit. I understand the ADU is required to be attached to the main house. There is a perfect location for me to add an exterior door to the main house and one the ADU with a connecting covered breezeway which would add nicely to the existing landscaping of the lot. Please see the included sketch that demonstrates how the existing and new structures could be integrated. I will continue the landscaping plan you will see in the adjoining photos to blend the new structure with the main house. Modern -shed has designed the perfect dwelling to compliment my existing house. After much research I feel this is a great option to create the ADU space with low impact on the neighbors and the planet, but with a huge positive impact on my life. Being able to be independent through my retirement or offer a home to my family members would be a great accomplishment. I hope that the City of Edmonds can help me meet this goal.
