The subject lot is 42 feet wide and the side yard setbacks account for 35 feet of that width, leaving only 7 feet for development. The variance is approved. ORAL TESTIMONY Gina Coccia, Associate Planner for Edmonds, stated that staff had received a public comment letter from Kim Tran on January 12, 2012 (exhibit 9). Ms. Coccia testified that she deduced that Kim Tran is a neighbor with property to the south of the applicant's property. She added that she came to this conclusion by reviewing the property owner list. Ms. Coccia noted that Ms. Tran referenced a variance in her letter, Variance V 1989-28. Ms. Coccia commented that she did not come across this specific variance when she was doing her research of previous variances for the neighborhood in question. V 1989-28 was located in archives, according to Ms. Coccia. She stated that the applicant has provided a survey completed by a licensed professional. Ms. Coccia testified that this survey demonstrates that, contrary to what Ms. Tran believes, Ms. Tran's property does not extend out beyond the setback variance. The building code requires buildings to be built at least 5ft away from each other, thus even if there was conflict the building could not be constructed within 5ft of Ms. Tran's building, according to Ms. Coccia. Ms. Coccia testified that the width of the lot is 42 feet and the setbacks are 35 feet, and added that the setbacks on each side are 5ft on the north and south property line. Ms. Coccia noted that she is unsure of the separation of the house from the south (along Ms. Tran's property line). She stated that the proposed house addition is shown about 5ft from the property line on the plans provided. Paul Dent, applicant, stated he has nothing to add. Kim Tran, 16340 750' P1 W Edmonds, stated that she is unsure of where her property line is located. She noted that she has been on vacation for the past three weeks, and thus she has been unable to speak with the applicant about the property line and according variances. She testified that the previous owner of her home (who was the Variance P. 1 Findings, Conclusions and Decision 0 • builder) told her the property line was straight from the roof eave to the next house. 1 She stated that she is worried the addition will make the house end right at her 2 property line and make the homes very close together. Ms. Tran commented that she believes the property line is at the end of the rockery. She added that she does not 3 know if the property line is diagonal with the v-shaped rockery. 4 Ms. Coccia stated that the property lots are very narrow in this area, and the Dent's property meets the 5ft setbacks. 5 6 EXHIBITS 7 All 8 exhibits listed on page 8 of the November 29, 2011 Staff Report were admitted into evidence, in addition to the staff report itself. At hearing a January 12, 2012 8 - email from Kim Tram was admitted as Exhibit 9. 9 FINDINGS OF FACT 10 Procedural: 11 12 1. Applicant. The applicants are Paul and Jenelle Dent. 13 2. Hearing. The Hearing Examiner conducted a hearing on the application on January 12, 2012 at 3:00 p.m. at the Edmonds Public Safety Complex in the 14 Council Chambers. 15 Substantive: 16 3. Site/Proposal Description. The Applicants request a variance to ECDC 17 16.20.030, which imposes side yard setbacks totaling 35 feet for both sides of lots in the RS-20 district. The Applicants' lot is only 42 feet wide, leaving seven feet for 18 development. The Applicants request that this 35 foot total be reduced to ten feet to 19 allow a house addition to be placed within five feet of the side yard property lines. The existing three -bedroom home has a 928 square foot first floor and a 672 square 20 foot lower level. The existing home is located on the western end of the lot and the new addition is proposed just for the east side of the home. The proposed 21 development will expand the home to a four bedroom house with a two car garage. The record does not provide any information on housing sizes in the vicinity, but in 22 Edmonds it is reasonable to presume that a 1,600 square foot home is relatively small. 23 The Applicants' proposed expansion to a four -bedroom home with a two car garage is presumed to be more consistent with the size of the homes in the vicinity with the 24 same zoning. The existing lot and home were legally established under the County's jurisdiction, which justify approval of the variance. The lot is well under half the 25 required lot width for the zone, and well under half the minimum lot area for the zone. The subject lot is located in a residential neighborhood and the use is existing and will not change. 5. Adverse Impacts. No significant adverse impacts are reasonably anticipated from the administrative record of this project. Kim Tran, a neighboring property owner to the south, asserts that the Applicants property line runs along the eve of their roof line and that authorizing the variance would cut off a rockery that separates her home from the proposed addition. It is difficult to understand what Ms. Tran is asserting. As depicted in the site plans, Ex. 5, the variance would not result in any encroachment into the rockery and also would not result in any encroachment past the property line alleged by Ms. Tran, i.e. the roofline of the Applicants' currently existing home. Ms. Tran's assertion that the property -line is -along the Applicants' roofline is also inconsistent with her statements that her home has a five foot variance from the Applicants' property line. The separation between her home and the Applicants' proposed addition as depicted in the Ex. 5 site plans is ten feet, which would be consistent with the five foot setbacks depicted by the Applicants in their site plans. To the extent that Ms. Tran is asserting a trespass on her property, the Examiner does not have the authority to adjudicate ownership rights/property boundaries. See Halverson v. Bellevue, 41 Wn. App. 457 (1985). If Ms. Tran believes that the addition will result in a trespass onto her property she is encouraged to speak to an attorney on how to resolve her boundary issues in a court of law. If she has a valid trespass issue and acts quickly enough she may be able to acquire injunctive relief against the Applicants that would prohibit any trespass. Ms. Tran also raises concerns about fire safety due to the proximity of the addition to her home. Fire separation is governed by the Uniform Fire Code ("UFC") and the addition will be required to comply with the UFC fire separation requirements in order to qualify for building permit approval. Finally, Ms. Tran also raises a concern about "wall to wall" homes, which could be reasonably construed as expressing a concern over aesthetic impacts. Ms. Tran's shoreline views are apparently already blocked by the Applicants' existing home and from what information is in the record it doesn't appear that the eastern addition will result in any significant additional view blockage. As to view impacts beyond those affecting the Trans, the staff report notes that the subject property slopes down to the shoreline and that because of this slope the home will appear to be one story (15 feet) in height. The staff report also notes that a critical areas waiver has been issued for the project and that no adverse environmental impacts are anticipated. There is no evidence to the contrary. 25 11 CONCLUSIONS OF LAW Procedural: Variance p. 3 Findings, Conclusions and Decision 2 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 1. Authority of Hearing Examiner. ECDC 20.85.020 provides the Hearing Examiner with the authority to review and act upon variance applications as Type III - A. Substantive: 2.' Zoning Designations. The area is zoned Single -Family Residential (RS- 20). 3. Review Criteria and Application. Variances to setback requirements are set by ECDC 20.85.010, quoted below and applied through corresponding conclusions of law. ECDC 20.85:010:-No variance may be approved unless all of the findings in this section can be made. ECDC 20.85.010.A(1) — Special Circumstances: That, because of special circumstances relating to the property, the strict enforcement of the zoning ordinance would deprive the owner of use rights and privileges permitted to other properties in the vicinity with the same zoning. a. Special circumstances include the size, shape, topography, location or surroundings of the property, public necessity as ofpublic structures and uses as set forth in ECDC 17.00.030 and environmental factors such as vegetation, streams, ponds and wildlife habitats. b. Special circumstances should not be predicated upon any factor personal to the owner .such as age or disability, extra expense which may be necessary to comply with the zoning ordinance, the ability to secure a scenic view, the ability to make more profitable use of the property, nor any factor resulting from the action of the owner or any past owner of the same property; 5. The existing lot and home were legally established under the County's jurisdiction, which justify approval of the variance. The lot is well under half the required lot width for the zone, and well under half the minimum lot area for the zone. Without the variance the applicant would only have seven feet of lot width to develop. These factors constitute special circumstances that satisfy the criteria above ECDC 20.85.010(B) — Special Privilege: That the approval of the variance would not be a grant of special privilege to the property in comparison with the limitations upon other properties in the vicinity with the same zoning; 6. The existing three -bedroom home is only 1,600 square feet in area. The proposal is to expand to a four -bedroom house and two car garage. The record does not contain information on how large the expanded home will be or whether this size Variance p. 4 Findings, Conclusions and Decision 1 2 3 4 5 6 7 .8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 is comparable with other homes in the vicinity with the same zoning. However, it is reasonable to conclude that in Edmonds 1,600 square foot homes are unusually small and that the variance is necessary to expand to a size of homes more typically found within the vicinity with the same zoning. The criterion is satisfied. ECDC 20.85.101(C) — Comprehensive Plan: That the approval of the variance will be consistent with the comprehensive plan; 7. See Section VI of the staff report, adopted and incorporated by this reference as if set forth in full. ECDC 20.85.010(D) — Zoning Ordinance: That the approval of the variance will be consistent with the purposes of the zoning ordinance and the zone district in which -the-property is -located; 8. ECDC 16.20.000 provides that the purposes of the RS zones are to provide for single-family dwellings and nonresidential uses that complement and are compatible with single family use. The proposed expansion will result in a home that is of comparable size to surrounding homes. The expansion is consistent with the purposes of the RS-20 zone. The staff report also concludes that, other than the setback requirements subject to the variance application, the proposal is consistent with the requirements of the RS-20 zone and there is no evidence to the contrary. The criterion is satisfied. ECDC 20.85.010(E) — Not Detrimental: That the variance as approved or conditionally approved will not be significantly detrimental to the public health, safety and welfare or injurious to the property or improvements in the vicinity and same zone; 9. As determined in the findings of fact, there are not significant adverse impacts associated with the proposal. This criterion is satisfied ECDC 20.85.010(F) — Minimum Variance: That the approved variance is the minimum necessary to allow the owner the rights enjoyed by other properties in the vicinity with the same zoning. 10. The variance is the minimum necessary to enable the property owner to have a reasonably sized home compared to other homes in the vicinity. There is nowhere else on the property the home could be expanded without a variance. The existing home is situated on the western half of the lot and the new addition is proposed just east of the home. Because of the gradual slope down towards the water, the addition will appear to be one single storey (15') so no views should be compromised. They are proposing to rehabilitate their existing home and the addition r l� �c XP IT rol has been designed to fit with the character of the home. Because of the slope, the resulting product will not feel massive as viewed from the street. The home to the north is not near the property line, and it is situated so that it's garage and driveway are between it and the proposed addition. The home to the south is close to the south property line, separated by rockeries, and is logically the only property to have an impact by the proposed addition as it is proposed to be situated in a similar location east/west on the lot, whereas now the property to the south currently enjoys a staggered effect. However, the lot to the south is almost 70' wide and appears to have room to expand, whereas the applicant's property does not. No new traffic will be generated, because the site will still contain one single family. A waiver was issued from critical areas requirements under file CRA20040069, so it is unlikely that any adverse environmental impacts will occur from this addition. It is up to the discretion of the Development Services Department to require soils and geotechnical reports with the building permit application. VII. PUBLIC CONCERNS To date, no public comments have been received. VIII. FINDINGS OF FACT & ANALYSIS. 1. Site Description: A. Zoning: The zoning of the subject property is Single Family Residential (RS-20). B. Lot Information: The house was constructed in 1957 and then later annexed into the City of Edmonds on August 1, 1963. It is described as tax parcel number 00513106000900 and is 0.22 acres (about 9583 square feet). The minimum lot size for new lots in the RS-20 zone, so this lot is about half the size of a standard lot. The minimum lot width in the RS-20 zone is 100 feet, so this lot is less than half as wide as a standard RS-20 lot. C. Development: The site is currently developed with a small 3-bedroom single family home (928 square foot first floor and 672 square foot lower level, according to the County Assessor's records) while the floor plans submitted propose a four bedroom home with a 2-car garage. D. Terrain & Vegetation: The site slopes west down towards the railroad tracks. The City's LiDAR data indicates a 38-foot difference in elevation across the entire site (237 feet) between the street and the railroad tracks. E. Critical Areas: A critical areas "checklist" was submitted under file number CRA20040069 and it was determined that there are no critical areas on or adjacent to the property. Therefore, a 0 0 Dent Setback Variance - File No. PLN20110072 Page 4 of 7 "waiver" from Title 23 ECDC (the City's critical areas ordinance) was issued. During the site visit, staff noted no critical areas. The rolling slope will be re-evaluated during building permit review for compliance with Title 23 ECDC. F. Soils: According to the USDA soils map, this site consists of both `Alderwood Gravelly Sandy Loams " and "Alderwood-Everett Gravelly Sandy Loam. " G. Wildlife: None noted upon site visit. H. Access: The site is accessed via 75`'' Place West, which is considered a "Collector Street. " 2. Neighboring Development & Zoning: The site is located in north Edmonds.furthest west adjacent to the BNSF railroad tracks and Puget Sound. The neighborhood is a mix of RS-20 and RS-12 single-family zoned properties. 3. Edmonds Community Development Code (ECDC) Compliance: A. Bulk & Use Zoning Standards (ECDC 16.20): The fundamental site development standards pertaining to residential development in the RS-20 zone are set forth in Chapter 16.20.030. The table below illustrates the required and proposed setbacks to construct the new addition. The proposed addition will not be set further towards the side property lines than the existing home. The 42' wide lot would normally require 35' of side setbacks, leaving room for a 7' wide building addition. The height of the addition is one storey, and height calculations will be required with the building permit, but it appears as though the project was designed to remain under the 25' height limit. The maximum lot coverage in all single family zones is 35%, and for a 9583 square foot lot this would mean the lotcoverage would need to remain under 3354 square feet. The site plan indicates the lot coverage is 3119 square feet. This will be evaluated with the building permit application, but it appears as though the applicant is attempting to meet all other development standards except for the side setbacks, which they are requesting relief from. B. Variance (ECDC 20.85): ECDC 20.85 states that an applicant may request a variance from the standards of this chapter pursuant to the procedures set forth in ECDC 20.85. This chapter also sets forth the mechanism whereby a provision of the code may be varied on a case -by -case basis if the application of the provision would result in an unusual and unreasonable hardship. ECDC 20.85.010 contains the findings that must be made in order for a Variance application to be approved. According to the aforementioned code section, "No variance may be approved unless all of the findings in this section can be made. Special Circumstances — Special circumstances exist on the site related to the size of the property and the width of the property. The existing lot and home were legally established under the County's jurisdiction, which justify approval of the variance. The lot is well under half the required lot width for the zone, and well under half the minimum lot area for the zone. 2. The existing home would get a face-lift and the proposed addition would include a 2-car garage. There have been approved setback variances in this neighborhood due to similar circumstances (relatively small lots in a zone that requires the largest setbacks), therefore, the approval of a variance'would not be a grant of special privilege. 3. Comprehensive Plan — See Section VI of this report for a discussion on consistency with the Comprehensive Plan for the City of Edmonds. The project is compliant with the goals and policies of the Comprehensive Plan related to "Residential Development." 4. Zoning Ordinance — See Section VIII.3 of this report for a discussion on consistency with the criteria given the zoning code of the City of Edmonds. If approved, the project would comply with the Zoning Code. The project requires a variance to the side setback requirements to be approved before it will comply with the requirements of the RS-20 zoning standards. 5. Not Detrimental —The proposal will not be detrimental or injurious to adjacent property owners nor to the public's health, safety, or welfare. No views will be obstructed by the addition, because it will be stair -stepped down the slope. No public comments have been received to date. 6. Minimum Variance — The requested variance is the minimum necessary to construct any addition on the property. The addition is as wide as the existing home, which is only around 35 feet wide. Anything more narrow would result in an addition that feels like a hotel room where you have to pass through one room to get to the next. The proposal is just wide enough to gain additional living area but not nearly as large as the other homes in the neighborhood. 7. The extension on the variance is being applied for due to a delay in determining where the tight lines/drains would discharge. We've been working with Burlington Northern for over 4 months and came to an agreement last month. Once the agreement with BNSF was made, we were able to finalize all the plans. (.civil, geo tech, structural, etc). All plans, reports, and misc. documents have been dropped off at the city and are being held by Linda Thornquist in the building department. We are missing a letter from our Civil Engineer and our Geo Technical Engineer. These letters should be obtained no later than next week. At that time, the building permit process will begin. There have not been any change to our site or neighborhood which affects our plans. You did the right thing by checking with the City prior to filing an official appeal — we are here to help you. The appeal information is in our City of Edmonds code. The Hearing Examiner is the one who makes the decision, and he is the one who is required to issue his decision in writing and mail it out to all parties of record. So, I received his decision in the mail just like you did. He was trying to helpby putting instructions for appeals in his decision, however, the information was unfortunately incorrect for this type of application. The 21-day reference deals with LUPA (Land Use Petition Act) appeals, which are for when the appeals process is exhausted through the City. It is not applicable for this file, because variances appeals are first required to go through the City Council for review and a decision is made by them. The following step in the appeal. process is to file a LUPA appeal with the County, if you or the Dent family did not agree with the Council's decision. I am trying to help you with your appeal. I responded via email yesterday afternoon as quickly as I could in order to assist you should you choose to appeal. This morning, I then re -read the "calculation of days" part of the code and determined that you actually get to utilize the weekend in this case, thus giving you more time to file an appeal. I thought this news would make you happy. Please know that I have already verified the answer to your questions with our City attorney and Planning Manager so there is no question what the appeals process is for the Dent variance. The lot is approximately 40ft wide by 220 ft. As a point of reference, lots in an RS20 area must be a minimum of 20,O00sq ft, have a minimum lot width of 100ft, and minimum side setbacks of 35ft total on each with a minimum of 10ft. The Dent family seeks approval of a variance at 16330 75th PI W Edmonds, WA for the remodel/addition of a single family residence. We feel a variance is fair and reasonable under the following criteria: 1) Special Circumstances- The property in question is 40ft wide. Currently, the zoning for this property is RS20. The side setbacks in this are noted above. Under this scenario, an addition/remodel would be 7ft wide. The width of the lot makes a variance necessary in order to proceed. We've attached a survey for your review. Exhibit B 2) Special Privelege- Any homeowner in our area has the right to build/remodel a home under the City of Edmonds Zoning regulations. Without a variance, the Dent's would be unable to do this addition. Being a unique lot, there are extreme limitations as to what can be built. The Dent's are not seeking an exception to the building code, just to build a home that falls within a narrow lot, yet still under the building codes of the city. 3) Comprehensive Plan- The comprehensive plan for this area is residential. The requested variance and proposed plan fall within the Comprehensive Plan. 4) Zoning Ordinance- The variance and proposed plan fall within the Zoning Ordinance which is a single family residence. 5) Not Detrimental- This variance, if approved, will not be detrimental to the public health, safety and welfare or injurious to the property or improvements in the vicinity or zone. The plan, as proposed, will be better for storm water detention and removal. Improved water control leads to better soil stabilization. • a The current residence is the lowest valued home in the area. Although not an eye- sore, any improvement/remodel to this home will lead to increased curb appeal and better site lines for all neighbors. This project will have no negative impacts to the neighbors. 6) Minimum Variance- As noted above, the current code would require that this remodel/addition be 7ft wide. This is clearly not an option. In designing this home, we looked to keep the same line as the existing home. In addition, we look to keep the setbacks at 5 ft which is where the current home sits. In addition, the neighbors home to the South also sits back 5 ft. In closing, we hope that you find this variance request reasonable and necessary based on the narrowness of this lot.
