Replacement planting is required. A. Introduction The applicant is proposing to remove two existing evergreen trees located adjacent to the southern property line of the site addressed 1130 5th Ave. S, near the southeastern corner of the site. Both trees were indicated as existing when the site was developed in the late 1970s with what is now referred to as the Seavue Condominiums. A rockery is located between the building and the southern property line, and both of the trees are located on the south side of the rockery. One of the trees appears to be getting too large for its location adjacent to the rockery, and the other tree appears to be in poor health. While trees on individual lots are regulated through ECDC 18.45, changes to landscaping on multifamily -zoned and commercially - zoned sites are subject to design review according to ECDC 20.13. The subject application does not trigger SEPA review; therefore, the proposal may be approved by staff as a Type I Decision, subject to the requirements of ECDC 20.01.003. Page 1 of 4 • • File No. PLN20120035 Seavue Condominiums Landscape Plan Modification B. Critical Areas A Critical Areas Checklist for the subject site was reviewed in 2012 under File No. CRA20120058. It was found that a stream may be located adjacent to the southwestern side of the site; however, it is undetermined if it is in fact a tributary of Willow Creek or if it is simply a "drainage ditch." As a result, a "Study Required" determination was issued in order to ensure compliance of future projects on the site with the applicable critical areas regulations.of ECDC 23.40 through 23.90. However, even if this feature qualifies as a stream, the trees proposed for removal are located over 100 feet away (the maximum potential stream buffer under ECDC 23.90.040), so no additional critical areas study is required for the subject application. C. Findings and Conclusions 1. The applicant submitted a land use application, cover letter, photographs and site plan on August 27, 2012 (Attachments 1 through 4, respectively). 2. The application became complete pursuant to ECDC 20.02.003 on September 24, 2012. 3. The Seavue Condominiums are located at 1130 5th Ave. S. The site is zoned Residential Multifamily, R,M-1.5. (Attachment 5) 4. The applicant is proposing to remove two existing evergreen trees located near the southeast corner of the site (Attachments 2, 3, and 4). 5. One of the subject trees appears to be growing too large for its current location adjacent to the top of a rockery, and the other tree appears to be in poor health. Photos of these trees provided by the applicant are included in Attachment 3. 6. Design review for the site was conducted by the Architectural Design Board in 1978 under File No. PLN197800010. A building permit for the original construction of the Seavue Condominiums building was issued under Permit No. BLD19780360. Both of the subject trees were indicated as existing on the original permit plans. . 7. There is very limited space for plantings between the southern property line and the existing rockery. The applicant has proposed replacement of the two trees proposed for removal with a weeping blue atlas cedar (Attachments 2 and 3). 8. Current landscaping requirements are contained within ECDC Chapter 20.13. Although the current landscaping requirements are different than the landscaping requirements that were in place at the time of original development of the site, any proposed changes to existing landscaping are subject to the current code requirements of ECDC 20.13. As such, Type II landscaping is required along the southern property line of the site. 9. Type II landscaping calls for evergreen and deciduous trees, with no more than 30 percent being deciduous, a minimum of six feet in height, and planted at intervals no greater than 20 feet on center. The two trees proposed for removal are spaced at approximately 20 feet on center from the other existing trees at the southeastern corner of the site. As such, two replacement trees are necessary in order to comply with the current landscaping requirements for spacing of trees along this portion of the southern property line. 10. Both of the trees proposed for removal are surrounded by ivy, and have ivy growing up the trunks. In order to minimize the potential of the ivy choking out the replacement Page 2 of 4 • File No. PLN20120035 Seavue Condominiums Landscape Plan Modification trees and any other existing plants, the applicant needs to maintain the ivy and prevent it from growing up the trunks of the replacement trees. D. Public Comments Administrative design review is a Type I decision subject to the requirements of ECDC 20.11 (General Design Review) and 20.01 (Staff Decision — No Notice Required). Therefore, no public notice was required for the subject application. ' E. Technical Review The subject proposal was reviewed by the Engineering Division, who recommended several conditions (Attachment 6). The Engineering Division's comments have been added as conditions to this approval. F. Decision Based on.the findings, conclusions and,attachments to this report, staff finds that the design review for file number PLN20120035 is APPROVED with the following conditions: 1. Trees shall be fell onto private property. 2. Vehicles and equipment shall be located on private property. Should it be necessary to utilize the City right-of-way to perform any of this work then the contractor shall apply for and obtain aright -of -way construction permit in advance of starting work. 3. Contractor/owner is responsible for keeping all debris on site and preventing any silt laden runoff from leaving the site and/or entering the city storm system. 4. Due to the proximity of the subject trees to the existing rockery, the applicant should leave the stumps and roots in place. If the applicant wishes to remove the stumps and roots, it is recommended that the applicant contact a geotechnical engineer to ensure that it would not cause issues to the stability of the rockery. 5. Two replacement trees shall be installed very near the locations of the removed trees. The replacement trees may be weeping blue atlas cedars or similar evergreen trees appropriate for the site. Both replacement trees shall be a minimum of six feet in height and shall be planted at spacing as close as possible to 20 feet on center from each other and from the existing trees to be retained. 6. The ivy growing on the subject site must be maintained so that is does not negatively impact the health of the trees and other vegetation on the site. G. Attachments' 1. Land Use Application Form 2. It is unlikely we will be able to have our tree guy back our here for another 30 days, and will assume your work will be complete by then. We appreciate your efforts, but not sure why this process would take so long. We are not developing land and cutting down trees for profit or removing them to change any views. We are working to protect our building. I hope your department would consider prioritizing actions by homeowners in a different manner than a commercial development situation. I have lived in Edmonds off and on for forty years, 25 as a homeowner. I have worked many times with my house with the planning department including doing complete remodels. I must say this particular permit seems to be the most frustrating in all that time. No further reply is necessary. I apologize that you were given a different impression on the timing of our application reviews when you were previously in at the counter. Although I mentioned the 120 day deadline on land use reviews, I certainly don't anticipate that this application will take that long, but it is typical for tree cutting permit applications to take approximately two months. The code does allow for removal of trees in emergency situations, but replanting would still be required. As I stated I normally take care of these matters and because of my work I have relied on another owner of Seavue to take care of this. It is my understanding we submitted the application nearly six weeks ago. We had scheduled to remove the trees before the end August and then found out the process was more extensive and not a simple process so cancelled the removal at that time. In my personal discussion with staff it was intimated a month was surely sufficient time based on our situation. We are now; again scheduled for removal of the two trees on October 8th, next Tuesday. You are advising us that we should not keep that day and you will not likely be issuing a permit that is timely to our action. It is also my understanding you have been to the property and seen the two trees we want to remove. As discussed after moving to this property last year during the late fall and winter I noticed the vulnerability of the several story and large pine tree growing in a •deep rockery that today you would require an engineered retaining wall. For this reason it is more than prudent to remove the tree. In addition the pine needles are causing problems with our roof and have backed up water and over the years caused considerable damage, even with removing the needles on a timely, periodic basis. The small tree adjacent to the big tree will in the end cause the same.problem over time and is currently contributing to the water damage. As far as the process, I understand things take time. You noted you have a 120 day cycle on this type of permit, we were unaware of this and 10/10/2012 • Page 3 of 3 J I do not believe thi is noted on the permit.. This is likely a reasonable amount of time on large projects like Point Edwards and others where there is substantial work and multiple trees. In this case there are two trees, at least one could pose an immediate threat to the property in a major wind storm. If however an event of this kind did take place and the tree did fall into the building, the City would just say that was unfortunate. For us it would me thousands of dollars of damage, assuming no one was hurt. Trees are important to the community and I support reasonable measures to ensure we are careful and do not indiscriminately cut or butcher trees. However not offering a timely method will frustrate individuals and put them in a position of avoiding the good rules. We would not wantthis tree process to get to that point and I hope you will take this into consideration as you manage the work flow of requests. We feel prevention is a prudent measure. We have made a suggested alternative type tree to put in place of the current trees as required. This particular tree will enhance the property and will likley ensure no potential damage to the structure in the future. I would ask your immediate consideration of this issue and issue the permit so we could continue with scheduled removal next Tuesday. If you do not it will likely take us another six weeks to reschedule. This puts is in a time when we will likely have rain and even windy weather. This could further delay finding a day that it is safe to remove the trees. In addition we have. had to work with our apartment neighbor that borders the tree line as we have made arrangements to have their parking area cleared for two days. The small tree adjacent to the big tree will in the end cause the same problem over time and is currently contributing to the water damage. As far as the process, I understand things take time. You noted you�have a 120 day cycle on this type of permit, we were unaware of this and I do not believe this is noted on the permit. This is likely a reasonable amount of time on large projects like Point Edwards and others where there is substantial work and multiple trees. In this case there are two trees, at least one could pose an immediate threat to.the property in a'major wind storm. If however an event of this kind did take place and the tree did fall into the building, the City would just say that was unfortunate. For us it would me thousands of dollars of damage, assuming no one was hurt. Trees are important to the community and I support reasonable measures to ensure we are careful and do not indiscriminately cut or butcher trees. However not offering a timely method will frustrate individuals and put them in a position of avoiding the good rules. We would not want this tree process to get to that point and I hope you will take this into consideration as you manage the work flow of requests. We feel prevention is a prudent measure. We have made a suggested alternative type tree to put in place of the current trees as required. This particular tree will enhance the property and will likley ensure no potential damage to t1he structure in the future. I would ask your immediate consideration of this issue and issue the permit so we could continue with scheduled removal next Tuesday. If you do not it will likely take us another six weeks to reschedule. This puts is in a'time when we will likely have rain and even windy weather. This could further delay finding a day that it is safe to remove the trees.
