Edmonds WA. 98020 RECEIVED SUBJECT: PLN20130014 Conditional Use Permit for Tree Removal AUG 2 12014 Mr. Clugtson, DEVELOPMENT SERVICES I am making a request for extension of the conditional use permit according to ECDC 18.45.045. The circumstances regarding my inability to perform the permitted work within the past year is outlined in the following timeline: the Bond or Insurance due to TCE problems. Clugston letter 8/18/2014 reviewed by. The CUP tree removal suspension has still not been lifted to date 8/21/2014 Conclusion: A critical area was determined to be an erosion sensitive steep slope in the area of the tree location. Therefore, removal of the tree and construction of the retaining wall should be carried out during seasonally favorable weather conditions. The time requirement for removal of the tree and construction of the SS-2 retaining wall is in excess of 2 months. Permit application was 3/7/2013 and issuance was not until 8/23/2013. 1 made every effort to get the permit approved and issued prior to the end of the 2013 seasonal favorable weather conditions. The weather conditions and time frame required to perform the permitted work was not favorable after issuance of the permit. I began rescheduling the project in June 2014. The City suspended the Civil permits PLN20070076 and the CUP tree removal Permit June 24,2014. 1 responded to the Citys concerns in my letters and during meeting with Staff. An agreement was reached, between staff and myself, Phil Williams Letter July 23, conditions were added to the Civils and I executed the Civils with the understanding that all permits would be reactivated. The Civils were reactivated not the CUP tree removal permit. The City Planning Department refuses to accept the Frozen Bond Fund and required insurance Thuesen/ Reidy as additional insured. There is no reason for the City to refuse the Bond and Additional insured documents supplied. The Frozen Bond Fund was executed on a City form per City requirements. The additional insurance adding Reidy and Thuesen is per insurance standards and settlement language and covers both Reidy and Thuesen. All conditions have been met. A 6 month extension is the maximum allowed. My concern is the time frame that the permit will be released. I need to perform the work during the seasonal favorable weather. I also am requesting that the extension fees be removed due to conditions of delay beyond my control. Eric Thuesen
