Project Description The property owner is proposing to remove one large cedar tree at 1101h Ave. N. The tree is very close to the building to the south which provides climbing access to adjacent roofs. C. Findings and Conclusions 1. The subject property is zoned BD1 (Downtown Retail Core). The surrounding properties are zoned and developed similarly (Attachment 1). 2. A permit is required for the removal of trees on commercial and multifamily zoned parcels in accordance with Chapters 18.45 and 20.13 of the Edmonds Community Development Code (ECDC). 3. The building was constructed on the site in 1938. In 1978, the landscaping at the site was updated as shown in Attachment 2. Some changes to the site landscaping have taken place since that approval but most of the larger trees remain. 4. The subject cedar tree isn't shown on the 1978 landscaping plan but may have been substituted at the time of installation. In any event, the cedar is very close to the building to south and provides a climbing route to the roof of that building Page 1 of 3 File No. PLN20170039 Administrative Design Review Landscape Plan Modification at 110 41h Ave. N (Attachment 3). Removal of the cedar is proposed to eliminate the attractive nuisance. 5. Exterior landscape buffer enhancement is required when trees are removed from commercial parcels. In this case, Type III landscaping along the south property line would be appropriate in accordance with ECDC 20.13 to buffer the north wall of the building to the south. Installation of two Pontic Rhododendrons is proposed. D. Technical Review The Engineering Division reviewed the proposal and recommended several conditions that have been included with the decision (Attachment 4). Decision Based on the findings, conclusions and attachments to this report, the design review for file number PLN20170039 is approved with the following conditions: 1. This permit is valid only for the removal the cedar tree identified in Attachment 3. 2. Replacement vegetation recommended in Attachment 3 must be installed in approximately the same location as the tree removed along the southern edge of the property to screen the building to the south. Species substitution is acceptable if the proposed Pontic Rhododendrons are unavailable. 3. Trees shall be fell onto private property. 4. Vehicles and equipment shall be located on private property. Should it be necessary to utilize any portion of the City right-of-way, including the street or sidewalk, to perform any of this work then the contractor shall apply for and obtain a right-of- way construction permit in advance of starting work. A traffic control plan will be required as part of the right-of-way permit application. 5. Contractor/owner is responsible for keeping all debris on site and preventing any silt laden runoff from leaving the site and/or entering the city storm system. 6. Contractor/owner shall repair/replace any damaged sections of curb/gutter, sidewalk or other public improvements in City right-of-way per City standards that is caused by or occurs during the permitted project. 7. Contractor/owner is responsible for locating all on -site utilities. Relocation/revision/repair to any utilities may require separate permit. Attachments 1. Attachment 3 -00LW PLN20170039 Introduction I was contacted on January 12th, 2017 by Nate Wilson, who was representing his family who owns several commercial properties on 4th ave. North in downtown Edmonds where they would like to have several trees removed. This report concerns only the site described by the address 110 4th ave. North Edmonds, Wa 98020. The tree that Nate told me that he was hoping to remove from this address was a cedar tree that is located in the southeast corner of the property that is providing roof access to the adjacent gallery for loiterers. An email that was forwarded to me by Nate Wilson, that was written by Edmonds City Planner Kernen Lien, stated that the area affected by the removal would need to be brought into compliance with the city's current landscaping codes. The area of the property that contains the cedar tree will have to brought up to Edmonds' Type III landscaping regulations. Discussion On January 16th, 2017 I met Nate Wilson at the site to discuss the project. On the 17th of January I visited Kernen Lien at his office to confirm the specifications required to obtain the tree removal permit. This report contains a description of the property, an inventory of existing vegetation, a site map that describes the site and the existing vegetation as it currently exists, and a map that describes how the site will be brought into compliance with the city's codes after the removals are completed. Kemen Lien advised me that after the removal is completed the Wilsons will have one year to modify the site according to the new landscaping plan. In the southeast corner of the property there is a multi -stemmed Western Red Cedar (Thuja plicata) that is approximately 45' tall and has three main stems. It has a form that is less than desirable. It also has branching that extends all the way to the ground, and is located within one foot of the gallery to the south. The tree provides an easy means for people to ladder up to the roof of the gallery and can therefore lead to a situation in which the Wilsons could be liable for injury or damages that could occur. I support the removal of this tree. There is a photograph of the specimen included in this report. After removal, the city is requesting that the affected portion of the property line be brought into Type III landscaping compliance. The new landscaping plan is also included in this report, labeled `Drawing B,' and is accompanied by a written description of the planting plan. After the Western Red Cedar is removed I am suggesting that two 3' tall native Pontic Rhododendrons be installed along the southern border, 2' from the north wall of the gallery. The native plants will be able to thrive in the shady location. Because they are evergreen they will provide a visual buffer for the building. And because they mature at 15', they will not need any regular maintenance and they will never be able to serve as access to the roof of the gallery. In `Drawing B' the Rhododendrons are described by the letter `R.' Please note that the existing vegetation that is being retained is not described by `Drawing B.' Only the new plants to be installed are described in the drawing. Both drawings A and B adhere to a 1"=10' scale.
