PLN20170055 Dear Mr. Underbrink: The Planning and Engineering Divisions have reviewed the December 18, 2018 resubmittal of the draft recording documents for the Norton short plat, and it was found that the following information, corrections, or clarifications will need to be addressed before review can continue: New comments in red. 1. Title Report: Addressed, but. In accordance with ECDC 20.75.145.C, a title report issued within the last 30 days is required to verify that ownership and other interests in the land described and shown on the final plat is in the name of the person signing the owner's certificate. The title report submitted with the recording documents is more than a year old. Please submit an updated title report. December 19, 2018 Comment: Thank you for submitting an updated title report. See the discussion below regarding the legal description vs. survey discrepancies. If it can be demonstrated that the survey boundaries are the correct boundaries, then an updated title report verifying the legal description will be required. 2. Legal Description vs. Survey Discrepancies: Not adequately addressed. There are significant discrepancies between the property boundaries described in the legal description and those that are surveyed on the recording document. For instance the legal description describes the north property line as being 448.30 feet in length while the survey for the short plat identifies this property line as being 474.51 feet in length. Similarly along the southern property boundary the legal indicates a length of 535.09 feet while the survey indicates a length of 576.84. When I measure the parcel from the GIS layer it corresponds with the lengths identified in the legal description. Please explain why there is such a large difference between the legal description boundaries and those identified on the survey. December 19, 2018 Comment: In response to this comment, a note was placed on the survey stating that the distances in the deed were believed to be in error and included a reference to a survey recorded in 1974 under AFN 2348873 (Vol. 1 of Surveys, page 234). A belief that the Page I of 4 deed is incorrect is not sufficient information to overturn other records describing the property. Every deed on Snohomish County Auditor's website recorded since 2001 (AFN's 200106070385,200206280235,200405040822,200605121042,200107190514, 201609120361, and 201612140823) all contain the same measurements for the property. Both title reports submitted with the application contain the same legal description. The legal description of the property on the first page of the short plat matches the legal description of the deeds and the title reports. The legal description on the Snohomish County Assessor's page also matches the legal of the deeds and title report. The Snohomish County parcel layer shows a parcel (image below) that matches the dimensions of the legal description. The easement recorded for Cary Road under AFN 201411200596 contains this legal description and an image showing the parcel layout below. All of the evidence on record apart from the 1974 survey recorded under AFN 2348873 describes a different property than the one indicated in the survey. 827 830 828 809 ; * A. 806 . 730 309 305 1031 I I 705 In order for the short plat to be recorded with the property dimensions indicated, a title report demonstrating the ownership matching said property boundaries must be submitted. Otherwise the subdivision will have to be amended to match the property boundaries of the legal description provided in the deed. This would also result in the change of interior lines as Lot 1 is currently just at 12,001 square feet. If the subdivision is revised to match the legal description, if will have to be processed as a change in accordance with ECDC 20.75.110. 3. Addressed. Please add the line length for the southern property boundary on Lot 2 to the recording documents. December 19, 2018 Comment: Line length added, but may need to be correct depending on the results of the legal and survey discrepancies discussed above. 4. Addressed, but. Please show the addresses for the new lots of the subdivisions on the recording document as follows: Lot 1: 802 806 Cary Road Page 2 of 4 Lot 2: 806 812 Cary Road December 19, 2018 Comment: The addresses as indicate have been added to the short plat; however, the property owners requested different addresses. Please revise the addresses to those indicated above in red. Also, see attached address assignment. 5. Easements: Easement labeled, but. Please ensure all easements are shown on the final short plat. It does not appear that the easement recorded under AFN 201411200596 has been identified on the recording documents. December 19, 2018 Comment: A label has been to the survey for the easement recorded under AFN 201411200596; however, as discussed above in the legal vs. survey discrepancy section above, this may not accurately show the easement area. A map of Cary Road which was included as Exhibit B to the easement indicates a different parcel layout (a portion of Exhibit B is shown below. Depending on the results of the legal vs. survey discrepancies, the easement may need to be depicted differently. 6. Treasurer's Certificate: Addressed. 7. Parcel Number: Addressed. 8. Bond: Addressed. 9. Critical Area Notice on Title: Addressed, but recording fee required. Pursuant ECDC 23.40.270.13, sites with field -verified presence of critical areas and/or critical area buffers for which a permit application is submitted shall as a condition of permit issuance, record a notice of the Page 3 of 4 existence of the critical area and/or critical area buffer against the property with the Snohomish County Auditor's Office. Attached is a Notice of Presence of Critical Areas. Please sign and notarize this document. Prior to issuance of the building permit, this form must be recorded with the Snohomish County Auditor's Office. Options for recording include: Provide the City processing fee of $100 plus the County recording fee of $76 ($73 for first page and $1 for each additional page), for a total of $176, and the City will record the notice for you; OR Take the covenant to the County and record it for the County's recording fee of $73 for one page plus $1 for each additional page, and return a copy of the recorded notice to the Edmonds Planning Division with the Auditor's recording sticker on the copy. December 19, 2018 Comment: The critical area notice on title has been submitted for the City to record. A recording fee is required for the City to record. Please submit the $176 recording fee upon resubmittal. 10. Note that all signatures on the final documents must be made in black ink. It is suggested, however, that you submit the revised recording documents to staff for a second review prior to obtaining all required signatures. 11. Note that Snohomish County requires that all of the taxes for the subject site be paid prior to recording. Please make the above changes and submit your updated recording documents to the Planning Division. Sabina told me that the house in front has been 806 since it was built. They selected 812 for our current house because they were told to pick a higher even number, but could not choose 816 or 818 since those were the numbers of a duplex that existed there previously. They would like to keep 812 since every bill/document/proof of ownership up until now has been associated with 812.
