"Fire Protection Yard" coined by the architect was not the most exact term or situation used for the intent of the alternative design proposal. The intent was to establish adequate fire separation distance and assure proper egress between the existing OMT building and any building constructed to the south, that is a new parcel. As I see, the easement was proposed to 1) preserve the calculated exit from the 2nd floor (Ace) building to south completely to public way, 2) provide exposure protection for new constructed windowed openings on south wall 3) provide adequate separation from any (future) built exposure to the south lot, There was not intent in preserving the area for firefighters' use in laddering or operating next to the building. Also, OMT is also now fully protected by 903.3.1.1 automatic fire sprinkler system. Understand design requests are evaluated on their performance to "meet the spirit and intent" and it is not upon Building Dept to rewrite or redesign the original proposal of a licensed professional's work. Currently, there are no plans for a neighboring structure in the parking lot. As you point out, such a project will be contrary to the lease agreement as you point out. The fire separation distance required to build is assured by the easement. When a proposal is submitted as such will be the time we need to address the "building code violation for exiting and accessibility from the second floor" as outlined by B.O. approval letter dtd July 12, 2007. Consider Fire Services on board with your request for merchandising within the "Fire Protection Yard", so long as the accessibility and egress requirements are approved by Building. They feel there is an adequate opening for interpreting the intent of the covenants for what they were – a restriction on future development adjacent to Ace. Any redevelopment is highly unlikely in the next couple decades, since the parking is promised to Ace in their lease. With the Fire Department on board the Building Department would allow outside merchandising for Ace along the south side of the building. The City will require, at a minimum, a revised parking plan to relocate the ADA stall to a new location in the center section of parking stalls, closest to the entrance.
