Nguyen 10028 Marine View Drive Mukilteo, WA 98275 Subject: Request for information regarding tree cutting at the vacant parcel north of Haines Wharf Park (Parcel ID 00513105900600) Dear Mr. Nguyen: It has come to the City's attention that a tree cutting occurred on the parcel referenced above. This parcel belongs to you according to Snohomish County's property tax records. The site where the tree cutting occurred is located in the North Edmonds Earth Subsidence and Landslide Hazard Area, which is classified as a critical area pursuant to Edmonds Community Development Code (ECDC) Chapters 23.40 and 23.80. Since the site of the tree cutting activity was located within and adjacent to critical areas, a tree cutting permit and critical area review would have been required pursuant to ECDC 18.45.020 and ECDC 23.40 and no such review was requested prior to the tree cutting in question. As a result, this action constitutes a code violation which may be subject to treble penalties due to the location within critical areas and their associated buffers in accordance with ECDC 18.45.070. In order to rectify the situation, mitigate impacts to the critical area, and inform enforcement actions including potential fines, please provide the following information: 1. A report from an arborist certified in tree risk assessment detailing the extent of the cutting activity. The report must include a site plan identifying the location of all cutting activity, the species of the trees and other vegetation that was cut, the diameter of the vegetation that was cut, an assessment of the health of the trees that were trimmed and likelihood of survivability. 2. A geotechnical report assessing the impact of the tree cutting on the slope and recommendations regarding any debris that was left on the slope. 3. A mitigation plan consistent with the minimum performance standards for restoration detailed in ECDC 23.40.240.C. Please submit the requested information to the City of Edmonds by March 6, 2015.
