Revisions are required at this time; please respond to the following. Comments 1 — January 7, 2019 Comments 2 — January 8, 2019 1) January 8, 2019 — An updated letter of compliance was provided — thank you. The letter does not adequately address condition #2 of Resulution No. 1419, which states "... a utility access and emergency vehicle turn -around shall be constructed to City standards in a location agreed upon by the property owners, the City Engineering Division, and South County Fire for the benefit of the City of Edmonds and South County Fire." The response letter refers to the easement, but not the required construction. The City is in receipt of a performance bond that was submitted to address this requirement. Please revise the compliance letter to reflect this approach. In addition, the performance bond states improvements will be completed within 3 months and Duane and I had discussed a timeframe that pushed out the compliance date until June. Can you please confirm that 3 months (April 2019) will give sufficient time to find a good weather window to complete the turnaround. 1/7/2019 comment - In addressing the comments below, please provide an updated "Conditions of Approval Compliance Letter". 2) Utility Easement a. 1/7/2019 comment — addressed. 3) Utility and Emergency Vehicle Access Easement a. 1/7/2019 comment — addressed. January 8, 2019 — A separate declaration of covenant document was provided. ** Need approval by City Attorney ** 1/7/2019 comment — The covenant restrictions have been included in section 5 of the subject document; however, the restrictions are not in line with the conditions of Resolution No. 1419. Please revise (whether in a separate covenant document or not) to fall in line with the Resolution. Specifically, the covenant shall not be written to apply to additional parcels. The resolution states "The covenant shall provide that construction of the emergency access road will be a condition of building permit approval in the event that an additional single-family residence is proposed to be constructed and take primary or secondary access from any portion of the area to be vacated." 5) January 8, 2019 — Thank you for providing a road profile. In the staff report for the street vacation, South County Fire provided fire lane standards noting the fire lane mush be a minimum unobstructed width of 20-feet. The (18") asphalt thickened edge will therefore, need to fall outside the 20-ft pavement area. Please revise the easement area as needed. 1/7/2019 comment - Provide a cross section that shows the width of the existing access road, as well as the width of the proposed access road (to be improved as a condition of future buiding permit). Clearly indicate the proposed access easement area will align with the future improvement. 6) January 8, 2019 — Response letter notes that any portion of the existing road located outside the emergency vehicle easement will be removed when the full emergency access road is constructed at the time of future building permit. The timing on construction (widening) of the access road is acceptable, however, in the meantime the easements need to provide access over the paved roadway. Please revise the easement area accordingly. This can be seen on the boundary line adjustment document provided for PLN20170050. Please confirm the existing roadway does in fact fall within the proposed easement areas. If the existing roadway could be depicted on the composite drawing, that could be useful. The scale of the composite drawing may need to be adjusted to 1"=20'. 7) January 8, 2019 — Comment acknowledged. 1/7/2019 comment - Please note, the subject street vacation will be placed on the Februrary 51h City Council meeting. The conditions of Resolution No. 1419 will however, need to be met by January 14, 2019 (90 days from the date of adoption of the ordinance). 8) January 8, 2019 — Comment acknowledged. 1/7/2019 comment - Please also note, prior to construction of the access road turn around and any road widening, a construction plan will need to be submitted to the City for review and approval.
