Dear Mr. Schmaus:
I know you are aware that the expiration date for the preliminary approval of your
subdivision at 520 — 7th Ave. S (File No. S-04-113) is quickly approaching. The
preliminary approval will expire on Wednesday, March 10, 2010 if the subdivision is
not recorded prior to this date. Please keep in mind that it typically takes one to two
months for staff to conduct final subdivision review and approval as there are typically
changes that need to be made to the draft recording documents before staff can issue final
approval. Thus, it is very important that you submit for final review as soon as possible, and
it is also important that you allow a ample time for staff to conduct our final review as well
as time for your surveyor to make any required changes to the recording documents. Please
note that you must obtain an engineering final of all civil improvements or post a bond prior
to submittal for staff s review of the draft recording documents. In order to submit for final
review, please submit an updated title report prepared within 30 days of submittal, two
copies of your draft recording documents, and the $405 fee.
Additionally, I understand that you inquired with Jennifer Lambert, Engineering Technician,
about waiting until the spring to install the plants that were required as mitigation for
removing the previously existing vegetation on the steep slope. Since the plantings were
required prior to final approval, a bond will be required in order to guarantee installation of
the plants. If your landscaper determines that this is not a good time of year to install the
plants, you will need to submit a letter from your landscaper stating why this is not the
appropriate time to plant and providing a scheduled date of when the plantings will be
installed (any delays until after this spring will not be permitted). Additionally, since the
planting plan was required for permanent erosion control of the steep slope as mitigation for
removal of the previously existing plants, you will need to submit a letter from your
geotechnical engineer ensuring that either the temporary erosion control that is currently in
place will provide sufficient erosion control through the winter and until the required plants
are installed or that additional erosion control measures are necessary until the required
plants are installed. If your geotechnical engineer determines that additional erosion control
measures are necessary, you will need to install the required erosion control prior to final
inspection.

Pursuant to ECDC 23.40.290, staff may collect a bond for 120 percent of the estimated cost
(including all materials and labor) of the mitigation work. If you choose to bond for the
mitigation work, the timing for the completion of the planting plan will be limited to an
approximate three to four month window (exact timing to be determined following staff's
review of the letters from your landscaper and geotechnical engineer) in order to ensure that
the plantings will be completed prior to the summer as it is not advisable to plant during
summer months.
Whether you choose to plant prior to final approval or post a performance bond to plant this
spring, a 15 percent maintenance bond is required pursuant to ECDC 20.13.040.D. Any
plants that die within two years of installation must be replaced before the maintenance bond
can be released. Upon inspection and approval, the maintenance bond may be released after
two years. A statement to this effect will need to be included on the face of the recorded
plat.
