Dear Mr. Sherman,
The City issued an Order to Correct on June 22, 2006 to correct the violations at the property by July 10,
2006. Your son was also advised by phone to send a written compliance schedule before July 10, 2006 if
the corrections could not be accomplished by that date. No written compliance schedule has been received
as of July 11, 2006 and the property has not been brought into compliance. The next step in the
enforcement process is to issue a Notice of Violation which includes fines of $100.00 per day that the
violations exist.
The City is hesitant to use the Notice of Violation fines in situations such as yours where progress is being
made, just not completed. The reasoning being that the City believes it makes more sense to allocate any
funds toward violation corrections instead of adding costs to those corrections. In the majority of cases the
property owner will communicate by submitting a mutually reasonable schedule to complete the
corrections, then correct the violations in the agreed upon time frame.
In some cases, property owners will ignore City requests or simply not communicate. In these cases the
City has no other option but to continue the standard enforcement process - 1) request, 2) Order to
Correct, 3) Notice of Violation and fines. In these cases property owners find they owe hundreds, and in
some cases, thousands of dollars in fines. They also find, when stating their case, that the case files, filled
with numerous communications and requests from the City, support the City’s position of “no other
option”. Please be advised that once the Notice of Violation fines are issued I can not withdraw them and
they are in effect until the violation is corrected.
The Notice of Violation is prepared. Accordingly, unless a compliance schedule can be communicated and
mutually agreed upon by July 14, 2006 the Notice of Violation will be issued and will accumulate fines of
$100 per day until the property is in compliance.
