Edmonds Public Safety Complex: Council Chambers 250 5th Avenue North, Edmonds WA 98020 The applicant (Pam Lemcke, Capital Projects Manager, for the City of Edmonds) submitted a land use application requesting a noise variance for temporary nighttime work at nine wastewater lift stations located throughout the City of Edmonds as part of a wastewater lift station rehabilitation project [Attachment 1]. According to the applicant's cover letter [Attachment 2] : Work at each station will result in temporary disconnection of electrical and mechanical equipment used to move wastewater through the station and the pressure pipe ('force main') downstream of each station for improvements and equipment replacement. The contractor will be required to maintain continuous sewer service at all stations, using temporary power supply and/or pumping equipment as appropriate to the site conditions and his reasonable and efficient methods. The contractor will be required to use temporary pumps and power supplies for continued service. He will also be required to have redundant pump andpower supply equipment at each site. The duration of each temporary equipment operation is anticipated to be between two and four weeps, but may be longer if construction or unanticipated conditions warrant an extension. The force main at some stations will be replaced, necessitating use of temporary force main piping from the station to the point of discharge (typically a sewer manhole). The project is scheduled for completion within 250 working days (approximately 14 months with reasonable allowance for bad weather). The rehabilitation work will take place during normal construction hours, within the constraints of the noise ordinance. All stations are in residential areas, with proximity to residential units ranging from less than 20 feet to over 100 feet. II. GENERAL INFORMATION: A. Request: A variance to allow equipment noises later than the hours provided for in Section 5.3 0.110 of the Edmonds City Code (ECC) to allow for rehabilitation work to be conducted at nine wastewater lift stations within the City of Edmonds (Lift Stations #3, 4, 5, 9, 10, 11, 12, 14, and 15). B. Review Process: Pursuant to ECDC 20.01.003, a request for a noise variance is reviewed as a Type III -B decision, where the Hearing Examiner conducts a public hearing and makes the final decision. C. Major Issues: 1. Compliance with ECC 5.30 (Noise Abatement and Control) 2. Compliance with ECDC 20.85 (Variances) D. Applicant: Pam Lemcke, Capital Projects Manager, for the City of Edmonds. E. Site Information: The proposal is for rehabilitation work at the following nine wastewater lift stations within the City of Edmonds (refer to Attachments 3 and 4 for additional information on each site location): 1. Owner: Ownership of each of the lift station sites varies. Lift Stations #9 and 12 are located within city -owned right-of-way, while all of the other lift stations subject to this application are located on private property. Refer to Attachment 4 for location and ownership information for each site. Additionally, the applicant has provided a summary map as well as easement and court -order documentation for the sites that require work to be conducted on private property, which are included within Attachment 11. G. Zonin : The zoning designations for each of the lift station sites are provided within the site information above. Zoning maps are included for reference as Attachment 6. H. Existing Use: All nine of the project sites contain existing wastewater lift stations. Several of the parcels where the subject lift stations are located also contain existing single-family or multi -family residences, while some of the subject lift stations are located within the City's right-of-way. The requested noise variance is only for rehabilitation work to the existing lift stations and does not include work to any of the existing residential uses sharing property with the subject lift stations. I. Proposed Use: No change. The land use application is included as Attachment 1. With the application submittal, the applicant provided a cover letter [Attachment 2], a vicinity map [Attachment 3], and specific location and ownership information on each lift station site [Attachment 4]. The applicant also provided plan details for each lift station [Attachment 5]. In order to provide further documentation on ownership of each lift station site and the City's authority to conduct the restoration work in each location, the applicant has provided a summary map as well as easement and court -order documentation for the sites that require work to be conducted on private property [Attachment 11]. Variances granted based on special circumstances are exempt from SEPA review (WAC 197-11-800(6)(b) and ECDC 20.15A.080). The purpose of the City's Noise Abatement and Control ordinance is stated in ECC Section 5.30.010 as the following: "To minimize the exposure of citizens to the physiological and psychological dangers of excessive noise and to protect, promote, and preserve the public health, safety, and general welfare. It is the express intent of the city council to control the level of noise in a manner which promotes commerce, the use, value and enjoyment ofproperty, sleep and repose, and the quality of the environment. " Variances from the maximum permissible noise levels are established in this ordinance within ECC Section 5.30.120. 2. Edmonds City Code (ECC) Section 5.30.040 provides the maximum permissible sound levels for various districts [Attachment 7]. For noises generated within residential districts, the allowable noise levels for adjacent residential zones is 55 decibels. ECC Section 5.30.050 contains provisions for modification to the maximum permissible sound levels, including the requirement that the permitted noise levels shall be reduced by 10 decibels for receiving property within residential districts between the hours of 10:00 p.m. and 7:00 a.m. This code section does provide an allowance to exceed the maximum permissible noise levels at any hour of the day or night, but only for very limited amounts of time. 3. According to the applicant's cover letter (Attachment 2), it is necessary to exceed the maximum permissible sound levels established in ECC 5.30.040 and 5.30.050 in order to run equipment that will maintain continuous sewer service during the length of time needed for the rehabilitation work. Once each lift station has been has been rehabilitated, this additional pumping equipment will no longer be necessary. As such, the noise variance is only necessary for the length of time that it takes to complete the rehabilitation work at each site. 4. Various other sections in Chapter 5.30 give modifications to those maximum permissible sound levels. Section 5.30.110 lists the "Sounds exempt during daytime hours" which includes subsection A. "The following sounds are exempt from the provisions of this chapter between the hours of 7:00 a. m. to 10: 00 p. m.: ... 3. Sounds created by the installation or repair of essential utility services or public road projects." Subsection B also allows "[s]ounds originating from temporary construction sites as a result of construction activity are exempt from the provisions of this chapter, but only during the hours of 7: 00 a. m. to 6: 00 p. M. on weekdays and 10: 00 a. m. to 6: 00 p. m. on Saturdays, excluding Sundays and federal holidays." 5. Although the construction noises associated with the rehabilitation work will be exempt from the maximum permissible sound levels during the construction hours established in ECC 5.30.110, the requirement for the noise variance arises from the need to run equipment through the night and during non -construction hours in order to maintain continuous sewer service during the length of time the rehabilitation work is being conducted. Subsection A requires a finding "that immediate compliance with such requirement cannot be achieved because of special circumstances rendering immediate compliance unreasonable in light of economic or physical factors, encroachment upon an existing noise source or because of nonavailability offeasible technology or control methods." 7. Rehabilitation of the nine subject wastewater lift stations is necessary in order for the City to provide continued sewer service to local residents. Given the high importance of sewer service to the City's residents, the inability for the project to proceed without an exception to the allowable nighttime noise levels is a special circumstance that satisfies the requirement of ECC 5.30.120.A. 8. Section 5.30.120.13 states that the variance "shall be granted only for the minimum time period found to be necessary under the facts and circumstances. " 9. Due to the need to run equipment through the night in order to maintain sewer flows even though construction activities associated with the lift station rehabilitation work will only occur during permitted construction hours, the request to exceed the City's noise standards for the time necessary to complete the rehabilitation work at each lift station site (anticipated by the applicant as approximately two to four weeks per site, but could be longer if unanticipated conditions are encountered) is the minimum necessary (ECC 5.30.120.13) to ensure the project is completed in an efficient manner while providing continued sewer service to affected residents. 10. Proposed mitigation measures are discussed in the applicant's cover letter in Attachment 2. These include the following: a. Nighttime activities shall be limited to those identified in the cover letter. b. Primary pumping systems shall be electric pumps or sound -attenuated engine -driven pumps to reduce noise as much as possible. c. A copy of the noise variance shall be kept at each project site at all times. d. The City will post a 24-hour complaint number on information signs. e. Residents within 300' of each site where nighttime activities will take place will be notified. These proposed mitigation measures have been added as conditions of approval. 11. The project has currently not yet gone to bid. As a result, it is uncertain when the rehabilitation work will be conducted at each wastewater lift station site. The applicant's cover letter (Attachment 2) indicates that the intention is for the rehabilitation work to begin in the spring of 2012 and continue through the summer of 2013. It should be noted, however, that work will not be conducted at each site for this length of time. The applicant anticipates that the rehabilitation work will take approximately two to four weeks at each site, but may be longer if construction or unanticipated conditions warrant an extension. Pursuant to Edmonds City Code (ECC) Section 5.30.120.C.3, in those circumstances where variances to the noise standards are anticipated, the variance must be processed in the same manner provided for in Edmonds Community Development Code (ECDC) Section 20.85.020. 2. Pursuant to ECDC 20.85.010, "No variance may be approved unless all of the findings in this section can be made. " These required findings are as follows: a. Special Circumstances. That, because of special circumstances relating to the property, the strict enforcement of the zoning ordinance would deprive the owner of use rights and privileges permitted to other properties in the vicinity with the same zoning; i. Special circumstances include the size, shape, topography, location or surroundings of the property, public necessity as ofpublic structures and uses set forth in ECDC 17.00.030 and environmental factors such as vegetation, streams, ponds and wildlife habitats; ii. Special circumstances should not be predicated upon any factor personal to the owner such as age or disability, extra expense which may be necessary to comply with the zoning ordinance, the ability to secure a scenic view, the ability to make more profitable use of the property, nor any factor resulting from the action of the owner or any past owner of the same property; b. �ecial Privilege. That the approval of the variance would not be a grant of special privilege to the property in comparison with the limitations upon other properties in the vicinity with the same zoning; c. Comprehensive Plan. That the approval of the variance will be consistent with the comprehensive plan; d. Zoning Ordinance. That the approval of the variance will be consistent with the zoning ordinance and the zone district in which the property is located; e. Not Detrimental. That the variance as approved or conditionally approved will not be significantly detrimental to the public health, safety and welfare or injurious to the property or improvements in the vicinity and same zone; f. Minimum Variance. That the approved variance is the minimum necessary to allow the owner rights enjoyed by other properties in the vicinity with the same zoning. 3. The requested variance is necessary to allow completion of rehabilitation of nine existing wastewater lift stations, which satisfies the special circumstances requirements of ECDC 20.85.010.A and also comports with the mandate of avoiding special privileges in ECDC 20.85.010.B. 4. The importance of sewer management systems is addressed in the Comprehensive Plan. The proposal would enable the City to provide continued sewer service to affected residents, consistent with the goals of the Comprehensive Plan. The majority of the subject sites are located within various residential zones, while two of the sites are within un -zoned right-of-way. The proposed noise variance is necessary to provide continued sewer service to developed properties throughout the city. 6. There would be nighttime noise impacts to surrounding uses that exceed the limits established in the City's noise ordinance; however, conditions of approval would ensure that noise impacts are mitigated to the maximum extent possible. 7. As stated previously, the requested timing necessary for each site (anticipated by the applicant as approximately two to four weeks per site, but could be longer if unanticipated conditions are encountered) is the minimum necessary to ensure efficient completion of the rehabilitation project, which is necessary to maintain continued sewer service. VI. TECHNICAL REVIEW COMMITTEE: This application was reviewed and evaluated by the City's Public Works Department and Engineering Division as well as Snohomish County Fire District No. 1. None of the reviewers had comments on the proposed noise variance [Attachment 9]. ECDC 20.03 provides the City's regulations for public notice of land use applications. A "Notice of Application and Public Hearing" dated March 8, 2012 and vicinity map were posted at all nine wastewater lift stations that are the subject of this application as well as at the Public Safety Complex, Development Services Department, and Library on March 7, 2012. This notice (in postcard form) was also mailed to residents within 300 feet of each of the nine wastewater lift station sites on March 7, 2012 (through Click -2 -Mail online service) using a mailing list provided by the applicant. A legal notice was published in the Herald Newspaper on March 8, 2012. Copies of the public notices, declarations of posting and mailing, and the adjacent property owners' list provided by the applicant are included as Attachment 10. To date, no public comments have been received. Based on the analysis and attachments to this report, staff recommends APPROVAL of the requested noise variance for the rehabilitation of nine wastewater lift stations with the following conditions: 1. Nighttime activities shall be limited to those identified in the applicant's cover letter (Attachment 2). 2. Primary pumping systems shall be electric pumps or sound -attenuated engine -driven pumps to reduce noise as much as possible. 3. A copy of the noise variance shall be kept at each project site at all times during the rehabilitation work. The applicant will post a 24-hour complaint number on information signs at each lift station site during the rehabilitation work. 5. The applicant will notify residents within 300 feet of each site where nighttime activities will take place prior to such activities commencing. 6. Sounds originating from the subject lift station sites as a result of the rehabilitation work, as described in Attachment 2, shall be exempt from the provisions of Edmonds City Code 5.30. The granting of a variance shall not relieve any person from the requirements of ECC 5.30.130 relating to public disturbance noises (ECC 5.30.120.13). 7. This variance shall only be for the length of time required to complete the project as described in the applicant's declarations as indicated in Attachment 2. 8. Individual elements of this project are required to meet all applicable city codes, and it is the responsibility of the applicant to apply for and obtain all necessary permits. ' ' W1L ECDC 20.85.020 describes the time limits for variance approval. An approved variance must be acted on by the owner within one year from the date of approval or the variance shall expire and be null and void, unless the owner files an application for an extension of time before the expiration and the city approves the application. An application for an extension of time shall be reviewed by the community development director as a Type II decision (Staff decision — Notice required). Any person wishing to file an extension should contact the Planning Division at 425.771.0220 for further procedural information. APPEALS: Pursuant to ECDC 20.07.004, a party of record may submit a written appeal of a Type III - B decision to the Development Services Director within 14 days after the date of issuance of the decision. The appeal shall be made in writing and shall include all required information stated in ECDC 20.07.004(D) as well as the applicable fee. We are including a variance application for processing, notarized adjacent property owners list, overall vicinity map outlining the location of each of the nine lift stations, a detailed site plan of each lift station including addresses. The construction schedule is still to be determined, but field work is anticipated to begin in spring 2012 and continue through summer 2013. The project consists of the rehabilitation of nine wastewater lift stations located throughout the City. Work at each station will result in temporary disconnection of electrical and mechanical equipment used to move wastewater through the station and the pressure pipe ("force main") downstream of each station for improvements and equipment replacement. Four stations (#5, 11, 14 and 15) serve small areas with five horsepower or smaller pumps, per station. The contractor will likely use electric pumps to maintain sewer service. Thus the noise level will be essentially the same as current and proposed operations. However, a standby power generator will be required to be in place for usage during a power outage that affects the station and surrounding area. Such usage should be considered an emergency use and therefore exempt from the typical noise threshold limits outside of the "daytime" period. The five remaining stations (#3, 4, 9, 10 and 12) serve larger areas, with five- to 25 -horsepower pumps per station. A common type of unit will operate continuously as the primary pumping device. This unit will be required to have a sound -attenuation enclosure, but it is not likely to lower sound levels to the limit in the noise ordinance for overnight operations. Therefore a variance is being sought to allow commercially available, sound -attenuated bypass pumping equipment for primary pumping service at these stations. A backup pump and/or generator will be required (but without the sound attenuation provisions) to be in place for usage during a power outage that affects the station and surrounding area. This equipment would also be used if there were a failure of the primary pumping unit. Such usage should be considered an emergency use and therefore exempt from the typical noise threshold limits outside of the "daytime" period. While the primary construction activities will take place during the daytime, the nighttime operations described above are necessary in order to maintain continuous sewer service during the rehabilitation of the existing wastewater lift stations. We propose the following measures to minimize impacts: 1. Nighttime activities shall be limited to those identified above. 2. Primary pumping systems shall be electric pumps or sound -attenuated engine -driven pumps to reduce noise as much as possible. 3. A copy of the noise variance shall be kept at each project site at all times. 4. The City will post a 24-hour complaint number on information signs. 5. Residents within 300' of each site where nighttime activities will take place will be notified. It is hereby declared to be the policy of the city of Edmonds to minimize the exposure of citizens to the physiological and psychological dangers of excessive noise and to protect, pro- mote and preserve the public health, safety and general welfare. It is the express intent of the city council to control the level of noise in a manner which promotes commerce, the use, value and enjoyment of property, sleep and repose, and the quality of the environment. [Ord. 2531, 1985; Ord. 2193, 1981]. 5.30.020 Definitions. As used in this chapter, the following terms (Revised 5/02) 5-38 ATTACHMENT 7 Edmonds City Code shall have the following meanings. All techni- cal terminology used in this chapter and not defined specifically herein shall be interpreted in conformance with American National Stan- dards Institute's Specifications. A. "dB(A)" means the sound level mea- sured in decibels, using the "A" weighting net- work on a sound level meter. B. "District" means the land use zone to which the provisions of this chapter are applied. For the purposes of this chapter: 1. "Residential district" includes all R classified zones and includes the Open Space zone. 2. "Business" zone means all zones des- ignated BN or BC. 3. "Commercial" zones include all zones classified CW or CG. C. "Emergency work" means work required to restore property to a safe condition follow- ing a public calamity, work required to protect persons or property from an immediate expo- sure to danger, or work by private or public utilities for providing or restoring immediately necessary utility services. D. "Equipment" means any stationary or portable device or any part thereof capable of generating sound. E. "Gross vehicle weight rating (GVWR)" means the value specified by the manufacturer as the recommended maximum loaded weight of a single vehicle. F. "Motor vehicle" means any vehicle which is self-propelled, used primarily for transporting persons or property upon public highways. Aircraft, watercraft, and vehicles used exclusively on stationary rails or track are not motor vehicles as that term is used herein. It includes motorcycles unless distinction is made in the context of use. G. "Motorcycle" means any motor vehicle having a saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground; except that farm tractors and vehicles powered by engines of less than five horsepower shall not be included. ME 5.30.030 H. "Muffler" means a device consisting of a series of chambers or other mechanical designs for the purpose of receiving exhaust gas from an internal combustion engine and effective in reducing sound resulting there- from. I. "Noise control administrator" means the person designated by the mayor to enforce the provisions of this chapter. In addition to the noise control administrator, any police officer may enforce the provisions of this chapter. J. "Person" means any individual, firm, association, partnership, corporation or any other entity, public or private. K. "Property boundary" means the sur- veyed line at ground surface which separates the real property owned, rented or leased by one or more persons from that owned, rented or leased by another or others, and its vertical extension. L. "Receiving property" means the real property within which sound originating from outside the property is received. M. "Race vehicle" means a motor vehicle not licensed for use on the public streets and/or which is used primarily for sanctioned or unsanctioned racing events. Race vehicle shall also include power boats used primarily for racing events. N. "Sound level meter" means a sound level measuring device either type I or type II certified special use meters as defined by American National Standards Institute's Spec- ifications. [Ord. 2531, 1985; Ord. 2193 § 3, 1981]. 5.30.030 Unlawful sounds. It is unlawful for any person to cause sound, or for any person in possession of property to permit sound originating from such property, to intrude into the real property of another per- son whenever such sound exceeds the maxi- mum permissible sound level established in this chapter. [Ord. 2531, 1985; Ord. 2193 § 4, 1981]. 5.30.040 Maximum permissible sound levels. The maximum permissible sound levels established by this chapter shall be reduced or increased by the sum of the following: A. Between the hours of 10:00 p.m. and 7:00 a.m. the noise levels shall be reduced by 10 dB(A) for receiving property within resi- dential districts, except for noise from electri- cal substations and existing stationary equip- ment used in conveyance of water by a utility. B. At any hour of the day or night, the applicable noise levels may be exceeded for any receiving property by no more than: 1. 5 dB(A) for a total of 15 minutes in any one hour period, or 2. 10 dB(A) for a total of five minutes in any one hour period, or 3. 15 dB(A) for a total of 1.5 minutes in any one hour period. [Ord. 2531, 1985; Ord. 2193 § 6, 19811. 5.30.060 Motor vehicle noises — Stationary test. It is unlawful for any person to operate any motor vehicle upon any public highway or easement road if the vehicle exhaust system exceeds the maximum permissible sound lev- els for the category of vehicle as measured at a distance of 20 inches (.5 meter) from the exhaust outlet under procedures set forth in WAC 204-56, as now exists or as hereafter adopted or amended. It is unlawful for any person to operate any motor vehicle or any combination of motor vehicles upon any public highway or easement road under any conditions of grade, load, accel- eration or deceleration in such a manner as to exceed the maximum permissible sound levels for the category of vehicle as measured at a dis- tance of 50 feet from the center of the lane of travel within the speed limit specified under procedures set forth in WAC 204-56, as now exists or as may hereafter be amended or mod- ified: Vehicle Category 45 mph or less Over 45 mph Motorcycles 78 dB(A) 82 dB(A) Motor vehicles over 10,000 pounds GVWR 86 dB(A) 90 dB(A) All other motor vehicles 72 dB(A) 78 dB(A) While on real property other than highways or easement roads, motor vehicles shall not exceed the maximum permissible sounds as specified herein for other than motor vehicles. It is unlawful for any person to operate, or for any owner to permit any person to operate, any motor vehicle upon the public highways or easement roads which is not equipped with a Edmonds City Code muffler in good working order, in constant operation, and which meets the requirements established by RCW 46.37.390 as now exists or as may hereafter be amended. [Ord. 2531, 1985; Ord. 2193 § 9, 1981]. 5.30.090 Tire noise. It is unlawful for any person to operate a motor vehicle in such a manner as to cause or allow to be emitted squealing, screeching or other such sound from the tires in contact with the ground or other roadway surface because of rapid acceleration or excessive speed around corners or other such reason; provided, that the sounds resulting from emergency braking to avoid imminent danger shall be exempt from this section. [Ord. 2531, 1985; Ord. 2193 § 10, 1981]. 5.30.100 Exemptions. The following sounds are exempt from the provisions of this chapter at all times: A. Noises caused by motor vehicles used for highway maintenance or noises caused in the performance of emergency work for the immediate safety, health or welfare of the community or of individuals of the commu- nity, or to restore property in a safe condition following a public calamity. B. Sounds created by bells, chimes or caril- lons not operating for more than five minutes in any one hour. C. Sounds originating from aircraft in flight, and from watercraft. D. Sounds created by safety and protective devices, such as relief valves, where noise sup- pression would defeat the safety release pur- pose of the device. E. Sounds created by fire alarms and emer- gency equipment operated by law enforce- ment, fire fighters and aid personnel. - F. Sounds created by the operation of equipment or facilities of surface carriers engaged in commerce by railroad. G. Sounds originating from officially sanc- tioned parades and other events to which the 5.30.120 general public is solicited to attend without charge and sounds originating from league or school sponsored athletic events. H. Sounds caused by natural phenomena and unamplified human voices, except for pub- lic disturbance noises as set forth in ECC 5.30.130. [Ord. 2531, 1985; Ord. 2193 § 11, 1981]. 5.30.110 Sounds exempt during daytime hours. A. The following sounds are exempt from the provisions of this chapter between the hours of 7:00 a.m. to 10:00 p.m.: 1. Sounds originating from residential property relating to homeowner -sponsored temporary projects for the maintenance and repair of existing homes and grounds, includ- ing but not limited to lawn mowers, saws, hammering and gardening. This exemption applies to the construction of such incidental appurtenances for existing homes as fences, decks, patios, carports, swimming pools, ponds, walkways and private kennels. This exemption excludes sounds from race vehi- cles. 2. Sounds created by blasting. 3. Sounds created by the installation or repair of essential utility services or public road projects. B. Sounds originating from temporary con- struction sites as a result of construction activ- ity are exempt from the provisions of this chapter, but only during the hours of 7:00 a.m. to 6:00 p.m. on weekdays and 10:00 a.m. to 6:00 p.m. on Saturdays, excluding Sundays and federal holidays. [Ord. 3469 § 1, 2003; Ord. 2531, 1985; Ord. 2193 § 12, 1981]. 5.30.120 Variances. A. Variances may be granted to any person from any requirement of ECC 5.30.040 or 5.30.110 if findings are made that immediate compliance with such requirement cannot be achieved because of special circumstances ren- dering immediate compliance unreasonable in 5-41 (Revised 12/03) 5.30.130 light of economic or physical factors, encroachment upon an existing noise source or because of nonavailability of feasible technol- ogy or control methods. B. Any such variance or renewal thereof shall be granted only for the minimum time period found to be necessary under the facts and circumstances. C. Variances shall be processed in the fol- lowing manner: 1. The mayor or his/her designee may grant no more than two administrative vari- ances during any six-month period for no more than two consecutive days in those cases where unplanned, unusual physical or eco- nomic circumstances arise which make it nec- essary to complete immediate construction work and notice to adjacent property owners is not feasible. Notice of the administrative vari- ance shall be given to the police department and posting the subject property by the appli- cant. Variances shall be applied for and granted in advance. Any period of violation shall be deducted from the two-day maximum. 2. In circumstances where it is not possi- ble to meet the normal variance process, the mayor or his/her designee may also grant no more than one administrative variance of longer than two days but no longer than seven days during any six-month period pursuant to this section. Notice shall be mailed to all prop- erty owners within 300 feet stating the admin- istrative variance allowed, any variance conditions and the duration of such adminis- trative variance. Notice shall also be given to the police department and posting the subject property by the applicant. 3. In those circumstances where vari- ances to the noise standards are anticipated, the variance must be processed in the same man- ner provided for in ECDC 20.85.020 utilizing the criteria found in this section. D. The grant of a variance shall not relieve any person from the requirements of ECC 5.30.130 relating to public disturbance noises. (Revised 12/03) 5-42 E. It is unlawful for any person knowingly to cause or make, or for any person in possession of property knowingly to allow to originate from the property, unreasonable noise which disturbs another, and to refuse or intentionally fail to cease the unreasonable noise when ordered to do so by a police officer. Public dis- turbance noises shall include, but shall not be limited to, the following sounds or combina- tions of sounds: A. Frequent, repetitive or intermittently continuous sounds made by any animal except that such sounds made in animal shelters or in commercial kennels duly licensed shall be exempt. B. Frequent, repetitive or intermittently continuous sounds made by any horn or siren attached to a motor vehicle except such sounds that are made to warn of danger or that are spe- cifically permitted or required by law. C. Frequent, repetitive or intermittently continuous sounds made in connection with the starting, operation, repair, rebuilding or testing of any motor vehicle, motorcycle, race vehicle, off-highway vehicle or internal com- bustion engine. D. Loud and frequent, repetitive or inter- mittently continuous sounds made by the use of a musical instrument or instruments or other device capable of producing sound when struck by an object, of a whistle, or of a sound amplifier or other device capable of producing, amplifying or reproducing sounds. E. Loud and frequent, repetitive or inter- mittently continuous sounds made by the unamplified human voice or voices between the hours of 10:00 p.m. and 7:00 a.m. Edmonds City Code F. Whenever it is stated in writing by three or more persons having separate residences in a neighborhood that any person is violating any of the provisions of this chapter, the noise con- trol administrator shall advise the person of the complaint and that such violation is a nuisance and must cease. Any person violating any provision of this chapter shall be guilty of a misdemeanor and, upon conviction thereof, be sentenced to a fine not to exceed $1,000.
