HANKEN, of Counsel "ALSO MEMBER OREGON BAR RECEIVED RE: PCC Natural Markets/City of Edmonds; Recording of Agreement Creating Yard for Fire Exposure Dear Ms. Graf: NOV 20 2007 As you will recall, we are counsel to Puget Consumers Co -Op d/b/a PCC Natural Markets ("PCC Natural Markets"). Last spring, we reached agreement with the City concerning an Agreement Creating Yard for Fire Exposure (the "Agreement") regarding the former Albertson's location in Edmonds. Pursuant to the terms of my letter of April 27, 2007, the City is currently holding a fully executed original of the Agreement as well as a check to the Snohomish County Recorder for $49.00 for the recording fees associated with the recording of the Agreement. I have included herewith a copy of my April 27, 2007 letter, executed by Scott Snyder, a copy of the Agreement, and a copy of a May 8, 2007 letter from Sandra S. Chase. PCC Natural Markets is now ready to submit its application for a building permit for construction work and improvements to the building located on the premises described in the Agreement. Therefore, by this letter, we request that you immediately record the Agreement in the official records of Snohomish County, Washington. In addition, and pursuant to the terms of the April 27, 2007 letter, upon recording of the Agreement, please provide. PCC Natural Markets a written approval of an Alternate Design Request for the "openings" described in the Agreement, and subsequently, provide PCC Natural Markets its building permit necessary to construct the improvements to the building pursuant to said application. rweber@wpblaw.com 1111 Third Avenue Suite 1800 Seattle, Washington 98101 (206) 682-3840 FAX: (206) 340-8837 www.wpblaw.com Jeannine L.
