Box 330310 Seattle, WA 98133-9710 206-440-4000 TTY: 1-800-833-6388 www.wsdot.wa.gov RE: 2 Administrative Variances - 2 days each Statewide LED Roadway Lighting Conversion and Removal Project SR 104 Mile Post (MP) 27.80 to MP 28.2 Dear Mr. Clugston: The Washington State Department of Transportation (WSDOT) requests two (2) Administrative noise variances for two days each within the City of Edmonds along State Route (SR) 104. WSDOT requests this variance under the Edmonds Municipal code - 5.30120.0 .1 - and the temporary relief from the requirements of Washington Administrative Code (WAC) 173-60-040. This exemption would allow WSDOT to conduct construction activities within the City of Edmonds between the hours of 10:00 P.M. to 7:00 A.M. between April 1, 2016 and October 31, 2016. I want to ensure that you are aware of the new 90 -day permit processing timeline for Department of Transportation projects and maintenance activities on a state highway. This new requirement became effective when Governor Inslee signed 2ESSB 5994 into law on July 6, 2015. The following new section has been added as RCW 47.01.485: (1) To the greatest extent practicable, a city, town, code city, or county must make a final determination on all permits required for a project on a state highway as defined in RCW 46.04.560 no later than 90 days after the department (WSDOT) submits a complete permit application for a project with an estimated cost of less than $500 million. (2) WSDOT must report annually to the governor and the transportation committees of the House of Representatives and the Senate in compliance with RCW 43.01.036 regarding any permit application that takes longer than 90 days to process. Please let me know when you determine that the permit application is complete or if you need additional information to process this permit. We value our ongoing relationship with your office. City of Edmonds January 26, 2016 Page 2 Project Description The project proposes to convert existing roadway lights into high efficiency LED technology where the lighting is needed and removes existing luminaires that are not providing benefits along corridors in the Northwest and Olympic regions. Construction Activities and Equipment Work includes hauling materials to and from the worksite, sawing luminaire posts as a part of the removal process, and changing existing bulbs as a part of the conversion process. The equipment we anticipate our contractor will require completing this work is detailed in Attachment 2 along with the projected noise levels at varying distances. Traffic Limitations The primary reason for conducting nighttime work is to avoid daytime traffic congestion on SR 104 within the city of Edmonds. If we were to use daytime lane and partial lane closures along this well -traveled route, we would expect to see disruptions in the urban circulation as well as increased travel times for the citizens of Edmonds. In addition, daytime partial closures could impact commercial and business traffic during business hours as well as potentially cause delays to school routes and normal road users. Attachment 3 lists the proposed lane closures for the SR 104 highway. Construction Noise Forecast and Mitigation for Nighttime Operations The noise levels originated from this operation are not expected to be noticeable to the residents in the vicinity of the nighttime work. Residents would perceive minor sound peaks over the existing background noise of the well -travelled interchange of SR 104 and SR 99. Furthermore, the noise levels coming from construction equipment will diminish with distance. A 6-dBA noise level decrease will occur with the doubling of distance from a stationary noise source. For example, a noise level of 70 dBA measured at 50 feet would be 64 dBA at 100 feet, 58 dBA at 200 feet and 52 dBA at 400 feet. Noise also decreases if an object interferes with the receiver's line of sight to the noise source. WSDOT is committed to reducing the inconvenience felt by those living near this project and will make reasonable efforts to minimize sound levels caused by nighttime work. To that end, WSDOT will require the contractor to adhere to the following noise reduction measures: 1. The Contractor shall use ambient sensitive backup warning devices on all vehicles. The Contractor may use back-up observers in lieu of back-up warning devices for all equipment except dump trucks in compliance with WAC Chapter 296-155-610 and 296-155-615. Truck tailgate banging is prohibited. All trucks shall be secured to prevent excessive noise from banging. . All trucks performing export haul shall have well maintained bed liners as inspected and approved by the Engineer. 4. Luminaire posts shall be placed on truck beds to avoid banging and excessive noise. 5. A copy of noise exemption shall be kept on the project site at all times. 6. Provide a WSDOT complaint number as well as a list of designated contact persons for the purpose of forwarding complaints.
