AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, DECLARING AN EMERGENCY AND
AMENDING ORDINANCES 4189 AND 4195,
RELATED TO THE EDMONDS CARES FUND
WHEREAS, the City Council adopted Ordinance 4189, which set out the provisions for
utilizing Edmonds' allocation of federal CARES Act monies to mitigate the local impacts of the
COVID-19 pandemic and related social, health and economic crises; and
WHEREAS, the City Council adopted Ordinance 4195, which amended Subsection B of
Section 4 of Ordinance 4189 to allow the possibility of more than one grant per household; and
WHEREAS, the City of Edmonds has been allocated an additional $632,550 from the
federal CARES Act, with a expenditure deadline of November 30, 2020; and
WHEREAS, it is imperative that the City Council take quick action setting out the
provisions for expenditure of this additional amount of CARES Act funding to mitigate local
impacts of the COVID-19 pandemic and related social, health and economic crises;
NOW THEREFORE;
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, ORDAINS AS
FOLLOWS:
Section 1. Section 1 of Ordinance 4189 is hereby amended as follows (deletions are
indicated by stfike thfoug ; additions are indicated by underline):
Section 1. The City of Edmonds hereby accepts an allocation of up to $1,''�00
$1,897,650 as the City of Edmonds' Federal CARES Act allocation, as administered and
disbursed by the Washington State Department of Commerce in the form of reimbursable
funds, in accordance with Federal CARES Act guidelines. Further the City Council
authorizes the Mayor to enter into the corresponding contract(s) with the Department of
Commerce for administration and disbursement of these funds.
Section 2. Section 3 of Ordinance 4189 is hereby amended to read as follows (deletions
are indicated by strike thr-ettgh; additions are indicated by underline):
Section 3. The Edmonds CARES Fund shall be administered by the Administrative
Services Director under the direction of the Mayor. Under the Mayor's direction, and to
allow the Administration to respond quickly to changing conditions or demands in the
City's COVID-19 response, if the administration forecasts an insufficient number of
responsive applications or eligible expenses in any Account described in Section 4 to
allow it to expend the full amount authorized herein, the Administration shall have the
authority to reallocate funds among the Accounts described in Section 4, below,
PROVIDED THAT, the authority to reallocate funds from one Account (the Source
Account) to another Account (the Receiving Account) shall not exceed ten percent of the
Source Account allocation set forth in Section 4, below.
Section 3. Section 4 of Ordinance 4189, as amended by Ordinance 4195, is hereby
amended to read as follows (deletions are indicated by strike thfoug ; additions are indicated by
underline):
Section 4. There shall be kept by and under the direction of the Administrative Services
Director, such books, accounts and records as are necessary to control and report the
CARES eligible expenditures, and shall further subdivide the cash account thereof into
three separately designated accounts as follows:
A. Account "A" shall be the "COVID-19 City Expenditure Reimbursement" account
into which $265,100 of the CARES Act funding shall be allocated to reimburse
those direct City expenditures required to provide City services in response to the
COVID-19 emergency that satisfy the CARES Act eligibility criteria.
B. Account `B" shall be the existing, City Council -approved "Housing and
Supplemental Relief Program" account into which a supplemental infusion of
$300,000 $430,000 to that program from the CARES Act funding shall be
allocated to reimburse those City expenditures incurred through said Program, in
compliance with the CARES Act eligibility criteria. In addition, $50,000 from the
Community and Economic Relief Program, initially earmarked as a potential
second round of funding for the Chamber Foundation WISH Grant program, shall
be reallocated to this account. Grant awards shall be in amounts up to $1,000 for

households of one to two members, while grant awards may be in amounts of up to
$1,500 for households of three or more members. More than one grant per
household over the program period may be authorized, based on an analysis of on-
going need and consideration of other new applications. An additional Snohomish
County -based human services organization shall be engaged by the City to assist in
administration of the existing Program.
C. Account "C" shall be the "Edmonds Business Support Grant Program" account
into which $700,000 $1,130,000 of the CARES Act funding shall be allocated to
reimburse those City expenditures incurred through provision of individual
financial support grants (in the form of loans that are forgivable after four months
of performance) of up to $10,000, through an open, competitive application
process, to eligible businesses that have suffered substantial business losses and
additional expenses due to the COVID-19 economic crisis, in compliance with the
CARES Act eligibility criteria, which criteria shall include, but not be limited to,
the following:
a. Businesses with zero to thirty employees (part-time and full-time
combined)
b. A demonstrated year -over -year business/revenue loss of at least 30% in
April or May 2020;
c. In business in Edmonds at least one year as of Apfi4 October 1, 2020;
d. Declared intent and expectation to remain in business at least four months
after receipt of the grant;
In addition, the Mayor and City staff shall employ reasonable, objective and
score -based selection criteria to award grants to applicants, as required in the case
of a large number of applications, including such considerations as the following:
i. Particular consideration will be given to businesses owned by people of
color, women, veterans, and other minorities;
ii. Particular consideration will be given to those businesses that have not
received federal, state or county government assistance, and secondary

consideration will be given to those businesses that received lower -than -
requested amounts of federal, state or county government assistance;
iii. Greater consideration will be given to those businesses that have
experienced relatively greater business/revenue loss year -over -year in
April or May 2020;
iv. Particular consideration will be given to geographic distribution across
Edmonds' various business districts in the award of these grants;
V. Particular consideration will be given to creative -sector businesses within
the State -certified Edmonds Creative District;
D. Account "D" shall be the "Edmonds Food Bank Support Program" account into
which $35,000 of the CARES Act funding shall be allocated to reimburse those
expenditures by the Edmonds Food Bank to provide food to persons in need in
Edmonds by supporting the following expected expenditures: $20,000 for holiday
season food support; $7,500 to help fund an automated ordering system for
delivery service to Seniors, ADA clients, Veterans and other COVID-impacted
community members; and $7,500 to add shelving to the delivery van to expedite
packing and disbursement of online orders.
E. Account "E" shall be the "Edmonds Learning Enhancements and Activities
Program (LEAP) Scholarship Support Program" account into which $37,550 of
the CARES Act funding shall be allocated to provide scholarship funding for full
or partial registration fees to Edmonds households of low income, below low
income, or hardship situations to help them enroll their school -aged children in
LEAP. Low-income household shall be defined as eligible for the Edmonds
School District free or reduced meal program.
Section 4. Severability. If any section, subsection, clause, sentence, or phrase of this
ordinance should be held invalid or unconstitutional, such decision shall not affect the validity of
the remaining portions of this ordinance.

Section 5. Declaration of Emergency. The City Council hereby declares that an
emergency exists necessitating that this Ordinance take effect immediately upon passage by a
majority vote plus one of the whole membership of the Council, and that the same is not subject
to a referendum (RCW 35A.12.130). The region is in the midst of a state of emergency due to
the COVID-19 virus, which has also become an economic emergency for many households,
particularly those who earned less than 60% of the Snohomish County median income in 2019,
and local small businesses.
Section 6. Publication. This Ordinance shall be published by an approved summary
consisting of the title.
Section 7. Effective Date. This Ordinance shall take effect and be in full force and effect
immediately upon passage, as set forth herein, as long as it is approved by a majority plus one of
the entire membership of the Council, as required by RCW 35A.12.130. If it is only approved by
a majority of the Council, it will take effect five days after passage and publication.
