This project is another in our continuing program of improving State Route l04 between Edmonds and Interstate Highway 5. This particular project involves grading, draining, surfacing and paving a new roadway alignment ,between Drayton Street and 5th Avenue. Itjappears that the City's concern relates to the large amount of paved area i mrolved in the holding lanes compared to the small amount of landscaping. You advanced a proposal to the Department that we should acquire remainders ofAots 18 through 24, lying north of James Street and provide a small mini sit~ -in type park which, according to your belief, would be an ideal resting pl!.ce for people waiting for a ferry. I.nladdition, your plan proposed the installation of restrooms within the street right-of-way of James street. Thy Department has carefully analyzed your proposal, and I am prepared to made the following recommendations to the Director of Highways and the Jli�hway Commission, if the proposal is acceptable to the. City. 1. The City of Edmonds would acquire the balance of the property of lots 18 through 24, and the State highway Department would participate with the City in the costs of that acquisition up to a maximum of $18,360. If the City will agree to the above provisions we would be prepared to landscape the area mentioned, as a part of our total landscape plan. The subject of providing for picnic areas gives us some concern. However, I thirk it is an issue which can be jointly resolved without too much dif- ficulty. I personally feel it would be more appropriate as a sit-in type park and to construct appropriate walking paths with park benches instead of promoting a picnic area per se. Various citi- zen groups have asked the Edmonds City Council to request additional consideration for im�r•ovements to beautify the terry storage area. These groups have been criti- cal of: what they consider a lack of landscaping and esthetic considerations in this new parking facility. The City therefore requests that the Highway Department pur- chase end develop a piece of land 50 ft. x 224 f,_ lying on the north of James Street and immediately east of the new storage area. This parcel of land would make an ideal site for either a landscaped greenbelt or a small park with play area. ,In exchange for the purchase and development of this property, the City would agree to maintain the property, including the street tree plantings along the storage area. During the hot, summer months of each year, many thousands of motorists will be using this storage area. I'rn sure that the presence of the nearbyl,trees and shade will be a welcome relief to many people. We further request that the proposed restrooms be relocated to the right-of-way of Jams Street immediately east of the storage area. This street location would provide greater convenience to The traveling public, and could be incor- porated into the park or greenbelt mentioned above. Also we believe that addi- tionaljtrees and landscaping should be installed on the southwest corner of Main and Subset. Artificial grass should be considered for the several raised traffic i contro islands, i We believe that one of the major justifications .for this request is the destruc- tive effect caused by the highway on the main Edmonds Park south of Dayton Street. Even though the State has not acquired any of this park property, a considerable devaluation will occur, through the proximity of many cars and trucks on the new i SR 104� People enjoy the use of this park because it gives them a feeling of a quiet torest area; however, this feeling will be destroyed by future traffic noise and the sight of speeding vehicles. Unfortunately it is impossible to place A dollar value on the loss of this pleasure. We believe the destructive I charac-eristics of this new }ighway facility would be. compensated for by the pur- chase �f additional land {pear Main Street as referred to in the first paragraph above. WITNESSETH: WHEREAS, the State is planning to construct SR 104; Edmonds Ferry Terminal to Dayton Street on a new location through the City of Edmonds, and WHEREAS, the State proposes to install landscaping on a portion of said project right of way, and and and CX-A* 1 WHEREAS, the State proposes to install restroorris in the vicinity of the Ferry Terminal, WHEREAS, the City desires that a mini sit-in type park be provided in this vicinity, WHEREAS, it is in the best public interest to combine the park and restroom facilities. NOW THEREFORE, it is mutually agreed that: The City agrees to acquire remainders of lots 19 through 24, lying north of James Street, as shown on the attached plans in green marked "EXHIBIT All, and by this reference made a part of this agreement. The State agrees to particiPate in the cost of said acquisition by the City in are amount not to exceed $18,360.00. The State will not be a party to any condemnation proceedings involving the properties should same become necessary. The State agrees to construct the facilities in accordance with a plan which shall be approved by the City in writing. The City shall have thirty (30) days to review said playa upon receipt from the State. Failure to reply within the time specified herein will constitute approval upon the part of the City. IV The City will make available that portion of James Street necessary for the construction of the restr•oom facilities and agrees that no future access to the park area, from the properties to the east, will be granted. V The City agrees to perform all maintenance, repair, or replanting of said landscap;ng including rights of way, as shcrrin in red on EXHIBIT " A". V 1' The City agrees to accept said landscaping, mini park and resirooms as hereinbefore described and further agrees to relieve the State from all responsibility in the maintenance of said landscaping, mini park and restrooms upon completion of construction, in conformance with the contract plans, specifications and detailed drawings therein. V I I It is provided and agreed that no liability shall attach to the State by reason of entering into this agreement except as expressly provided herein.
