Ordinance 1406ORDINANCE NO. / yQ AN ORDINANCE OF THE CITY OF EDMONDS, WASH- INGTON AMENDING ORDINANCE NO. 984, OF SAID CITY, SECTION 5.12.170 OF THE EDMONDS CITY CODE, PROVIDING UNIFORM MAXIMUM PENALTIES FOR VIOLATION OF ORDINANCES OF THE CITY OF EDMONDS AND THE EDMONDS CITY CODE WHEREAS, the authority of cities in the State of Washington to assess fines, penalties, forfeitures and impose jail sentences for violations of its duly enacted ordinances and code codifications has been amended and altered from time to time by the Washington State Legis- lature, and WHEREAS, such amendments create a problem of amending and updating various ordinances regarding penalty pro- visions on a case by case basis, and WHEREAS, it is desirable that the various ordin- ances of said city should have uniformity in maximum allowable penalties regardless of the date of enactment without piecemeal amendment for purposes of uniformity, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON DO ORDAIN AS FOLLOWS: Section 5.12.170 of the Edmonds City Code, Ordin- ance No. 984, be and the same is hereby amended to read as follows: "5.12.170 Penalties. Not withstanding any other city ordinance or provision of the Edmonds City Code regarding violations and penalties therefore, any person or persons who shall violate or fail to comply with any of the provisions of the ordinances of said city, including the Edmonds City Code, or any part thereof, shall upon con- viction of said violation be punished by a fine in any sum not exceeding the sum of five hun- dred dollars ($500), or by imprisonment in jail V,3 - "for a term of not exceeding ninety (90) days, or by both such fine and imprisonment. Each separate day during which any said violation occurs or continues shall be deemed to consti- tute a separate violation thereof and a sep- arate offense thereunder, and upon conviction thereof shall be punished as herein provided. This section is intended to supersede the pen- alty provisions of any and all previously adopted city ordinances in conflict herewith and in the event of conflict herewith said previously adopted ordinances shall be deemed amended to conform with the penalty provisions of this section."
