Ordinance 1407ORDINANCE NO. I q u AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON AMENDING ORDINANCE NO. 1351, SECTION 5.12.014 OF THE EDMONDS CITY CODE, BY PROHIBITING CERTAIN USE, MAINTENANCE AND STORAGE OF CERTAIN VEHICLES AND MACHINERY, WRECKING OR DISASSEMBLING OF VEHICLES OR MACHINERY OF ANY KIND, OR STORAGE THEREOF, WITHIN THE CITY OF EDMONDS AND PROVID- ING FOR PENALTIES FOR VIOLATION THEREOF. THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. The Edmonds City Code Section 5.12.014, and Ordinance No. 1351 of said city, be and the same is hereby amended to read as follows: "5.12.014 Littering and Injury to Property. Every person shall be deemed guilty of a misdemeanor who shall willfully: (1) Cut down, destroy or injure any wood, timber, grain, grass or crop, standing or growing, or which has been cut down and is lying upon the lands of another or of the city; or (2) Cut down, girdle or otherwise injure a fruit, shade or ornamental tree standing on the land of another in the city, or along any road or city street; or (3) Dig, take or carry away, without lawful authority or consent, from any lot or land within the city, or from any lands included in the city, any earth, soil or stone; or (4) Enter, without the consent of the owner or occupant, any orchard, or damage or deface any building or part thereof, or throw any stone or other missile at any building or part thereof; or (5) Throw, place or deposit, in any road, street, alley, highway, park, beach, or other public place in the city, any bottle, bottles, glass, glass- ware, tacks, nails, garbage, rubbish, or discarded matter; or (6) Throw, drop or leave any discarded object, debris, waste, paper, glass, can, garbage, rub- bish, trash, lawn rakings or other litter, upon any public or private property of another or waters within the jurisdiction of the city, unless such property is designated by the state, political subdivision thereof, or other municipal corporation "for the disposal of garbage and such person is authorized to use such property for such pur- pose or unless it is placed into a litter receptacle installed for such purpose. (7) Use property located within the City of Edmonds for the following purposes, except in areas zoned and licensed as wrecking yards or repair shops: (a) For the storage of unlicensed motor vehicles except in an enclosed building or garage; or (b) For wrecking or disassembling of motor vehicles or machinery of any kind, or storage of any parts thereof, except in an enclosed building or garage; or (c) For the storing or leaving of worn-out, wrecked, or abandoned vehicles or machinery of any kind except in an enclosed building or garage. For the purpose of this subsection (7), all motor vehicles not bearing a current motor vehicle state license within ninety (90) days following the be- ginning of any license year shall be deemed un- licensed. The restrictions herein shall not apply to any person who is repairing a currently licEiised motor vehicle registered in his name, or member of his immediate family, provided that all such work shall be accomplished on the property of his residence or a duly licensed wrecking yard or repair shop, and shall be completed within thirty (30) days of the commencement of such work or repair. During such time of work or repair, all body and mechanical parts and tools shall be stored out of the view of adjacent property owners and/or occupiers and out of view of persons util- izing the adjacent streets." Section 2. Any person found in violation of this Ordinance shall be subject to a fine in any sum not ex- ceeding five hundred dollars ($500), or by imprisonment for a term of not to exceed ninety (90) days, or by both such fine and imprisonment, as set forth in Section 5.12.170 of the Edmonds City Code.
