ORDINANCE NO. IY30
AN ORDINANCE VACATING A PORTION OF EDMONDS STREET
IN THE CITY OF EDMONDSt WASHINGTONt RETAINING AN
EASEMENT AND RESERVING TO THE CITY OF EDMONDS THE
RIGHT TO EXERCISE AND GRANT EASEMENTS THEREON FOR
PUBLIC UTILITIES AND SERVICES$ AND ACKNOWLEDGING
PAYMENT THEREFORE.
WHEREAS, a petition to vacate a street was filed
with the City Council of the City of Edmonds, signed by
the owners of more than two-thirds of the property abutting
upon property dedicated for street purposes, located in the
City of Edmonds, being a portion of Edmonds Street more
particularly described below, and
WHEREAS, the City Council of the City of Edmonds did
by Resolution No. 203 of said City duly adopted on the
20th day of May, 1969, set the 17th day of June, 1969, at
the hour of 8 p.m. of said day for the hearing and determin-
ation on said vacation, and
WHEREAS, said property having been independently
appraised at a fair market value of $1000 and the City
having been compensated by the representative of owners of
property abutting upon said street in the sum of $500, and
WHEREAS, it appears to the City Council that said
portion of Edmonds Street should be vacated and the said
City Council does hereby determine to vacate the same, as
hereinafter set forth.
NOW, THEREFOREt THE CITY COUNCIL OF THE CITY OF
EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. That the following described street in the
City of Edmonds, Snohomish County, Washington, being a por-
tion of Edmonds Street, legally described as follows:
The North ten feet of Edmonds Street between 8th
Avenue North and 9th Avenue North in the City of
Edmonds, Snohomish County, Washington.
be and the same is hereby vacated, provided that the City
of Edmonds does hereby retain an easement and reserves the
right to exercise and grant easements in respect to the
said vacated land for the construction, maintenance and
repair of public utilities and services.
Section 2. This ordinance shall take effect and
be in full force five days after its adoption and publication
as provided by law.
