AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON
ORDERING THE IMPROVEMENT OF CERTAIN PROPERTY
IN SAID CITY BY CONSTRUCTING CONCRETE SIDEWALKS,
RETAINING WALLS OR ROCKERIES, NECESSARY GRADING
AND BASE PREPARATION AND RELATED WORK NECESSARY
TO MAKE A COMPLETE IMPROVEMENT IN ACCORDANCE
WITH CITY STANDARDS; PROVIDING THAT PAYMENT OF
COSTS OF SAID IMPROVEMENT BE MADE BY SPECIAL
ASSESSMENT ON THE SPECIALLY BENEFITTED PROPERTY
ABUTTING SAID IMPROVEMENT, BASED ON SPECIAL
BENEFITS; CREATING A SIDEWALK CONSTRUCTION FUND
N0.1-79 ; AND PROVIDING FOR THE ISSUANCE AND
SALE OF SIDEWALK IMPROVEMENT DISTRICT WARRANTS.
WHEREAS, by resolution No. 440, passed by the City
Council on May 29, 1979, the City Council of the City of
Edmonds declared its intention to improve certain property
in the City as hereafter set forth, and
WHEREAS, due notice of the hearing upon said resolution
No. 440 was given in the manner as provided by law and such
hearing was held by the City Council as aforesaid, and all
persons appearing at said hearing were heard, and all written
protests filed with the City Council on or before said date
were duly considered and rejected by the City Council, and
WHEREAS, the City Council has now determined it
to be in the best interest of the City that said improvement
as hereinafter described be carried out, now, therefore,

THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. The following property within the City of
Edmonds, Washington is hereby ordered to be improved by
constructing concrete sidewalks, retaining walls or rockeries,
necessary grading and base preparation and related work
necessary to make a complete improvement in accordance with
City standards on both sides of 5th Avenue South from Walnut
Street to and including the intersection of the northerly
right-of-way line of State Route 104. The foregoing shall
be carried out in accordance with the maps, plans and
specifications prepared by the City Engineer and the same
are hereby adopted.
Section 2.
The City shall bear the cost of removing
existing deteriorated sidewalks, preparing the base and
placing required fill and constructing necessary rockeries.
The abutting property owners shall bear all other costs
necessary to make a complete improvement in accordance with
City standards. There is hereby created and established a
sidewalk construction fund No. 1-79 into which funds shall be
deposited the aggregate of the several amounts assessed,
levied and collected on the abutting property owners and
any loans the City may advance to the said,sidewalk construction
fund No. 1-79 from any available funds to pay the costs of
said improvement. Against said sidewalk construction fund
No. 1-79 shall be issued cash warrants for the costs and
expenses in connection with said improvement as the same
become due. Interest on unpaid warrants shall be paid at
a rate not to exceed 8% per annum.
Section 3. This ordinance shall be in full force
and effect five days after passage and publication by posting
as provided by law.
