AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 5.45.030(A) OF THE EDMONDS CITY
CODE TO REQUIRE ASSESSMENT OF ONE-HALF OF DETEN-
TION COSTS ON PERSONS HELD IN CUSTODY PURSUANT TO
A WARRANT OF ARREST ISSUED BY THE EDMONDS MUNICIPAL
COURT.
WHEREAS, the City currently requires a penalty assess-
ment equal to one-half the costs incurred by the City in confining
people sentenced to imprisonment, and
WHEREAS, the City of Edmonds also incurs considerable
expense in holding persons in custody pursuant to arrest warrants
issued by the Edmonds Municipal Court, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 5.45.030(A) of the Edmonds City
Code is hereby amended to read as follows:
"A. In addition to any fine, there shall be levied
a penalty assessment against each person sentenced
by the Edmonds Municipal Court to imprisonment for
violation of City ordinances or for contempt of
Court or who has been held in custody pursuant to a
warrant of arrest issued by the Edmonds Municipal
Court."
Section 2. Severability. If any section, subsection,
clause, phrase or word of this Ordinance is for any reason held
to be invalid or unconstitutional by a court of competent juris-
diction, such invalidty or unconstitutionality shall not affect
the validity or constitutionality of the remaining portions of
this Ordinance.

Section 3. This Ordinance shall be in full force and
effect five (5) days after passage and publication by posting as
provided by law.
