Ordinance 25320006.08007 09/27/85 WSS/naa 2532 ORDINANCE NO. AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, REPEALING CHAPTER 4.08 RELATING TO THE LICENS- ING OF AMBULANCE OPERATORS, AMENDING SECTION 4.72.010 TO DELETE A REFERENCE OF AMBULANCE OPERATORS, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, Chapter 4.08 of the Edmonds City Code provides for the licensing and regulation of ambulance operators, and WHEREAS, RCW Chapter 18.73, specifically Section 18.73.020, supercedes the City's ability to levy license fees and limits the City's ability to regulate ambulance operators to a level already regulated by the State, and WHEREAS, the City finds that such duplicative regulation without the cost reimbursement is not in the best interests of the health, safety and welfare of its inhabitants, now therefore, FOLLOWS: THE CITY COUNCIL OF EDMONDS, WASHINGTON, DO ORDAIN AS Section 1. Chapter 4.08, Ambulance Operators and all the Sections thereof, are hereby repealed. Section 2. Section 4.72.010, Definitions is hereby amended to read as follows: 4.72.010 DEFINITIONS In construing the provisions of this chapter, save when otherwise declared or clearly apparent from the context, the following definitions shall be applied: A. Person. The term "person" shall include one or more persons of either sex, corporations, partnerships, associations, or other entity capable of having an action at law brought against such entity, but shall not include employees of persons licensed pursuant to this chapter. B. Business. The term "business" includes all services and activities engaged in with the object of pecuniary gain, benefit or advantage to the person, or to another person or class, directly or indirectly, whether part-time or full-time, except those business activities for which licenses or franchises are required by the following chapters of the Edmonds City Code: 4.04 (Advertising License); 4.10 (Tow Truck Operators); 4.11 (Motor Vehicle Wreckers); 4.12 (Peddlers and Solicitors); 4/20 (Liquor Licenses); 4.48 (Cabaret Dances); 4.50 (Public Massage Parlors and Public Bathhouses); 4.56 (Sound Trucks); 4.60 (Taxicabs); 4.64 (Garbage Collection); (Obstructing Public Places); 4.68 (Community Antenna Television Systems); or by 4.75 (Pawnbrokers) and except nonbusiness activities carried on by a religious, charitable, benevolent, fraternal or social organization; provided, however, that the owner of any apartment building containing three or more rental units shall be considered to be engaged in a "business" for the purposes of this Chapter. Section 3. This ordinance, being an exercise of a power specifically delegated to the City legislative body, is not subject to referendum, and shall take effect five days after - 2 - nassa a an publication as provided by law.
