Ordinance 2104ORDINANCE NO. 2104 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING SECTION 20.10.020 OF THE EDMONDS CITY CODE TO ADD A NEW DEFINITION OF "SUBSTANTIAL CHANGE" TO SAID SECTION AND AMENDING SECTION 20.10.120(1) OF THE EDMONDS CITY CODE TO REQUIRE ENTERPRISES INSTALLING SIGNS OR EFFECTING SUB- STANTIAL CHANGES TO EXISTING SIGNS TO OBTAIN A PERMIT FROM THE DEPARTMENT OF COMMUNITY DEVELOPMENT. WHEREAS, the determination of whether or not there has been a substantial change made to an existing sign to require the sign to obtain approval from the Architectural Design Board and the permit required in Section 20.10.120 has been made by the City administration, and WHEREAS, the City Council has determined that the definition of a substantial change should be clarified in order to guide the City staff in the administration of the Sign Code, and WHEREAS, setting forth the situations constituting a substantial change to an existing sign will guide the City staff and the general public and thus allow a better administration of the Sign Code, and WHEREAS, the City Council finds that the circumstances set forth in this Ordinance do constitute substantial changes to existing signs which would warrant the exercise of the City's police power to require Architectural Design Board review and issuance of a sign permit, and WHEREAS, the City Council finds that the following -1- ordinance is in the best interest of the public health, safety and general welfare, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. A new definition of "Substantial change" is hereby added to Section 20.10.020 of the Edmonds City Code as follows: "'Substantial Change' shall occur in any of the following cir- cumstances: 1. The sign is relocated on the site. 2. The sign is repainted other than in its original color scheme. 3. Any change involving replacement of structural material which comprises 25% or more of the sign area, exclusive of normal and/or necessary maintenance, provided, however, re- painting or a mere change of name on the sign without any other alterations to the sign or sign structure shall not constitute a substantial change." Section 2. Section 20.10.120(1) of the Edmonds City Code is hereby amended to require a sign permit for signs that are substantially changed to read as follows: "l. Permit Required. No enterprise shall install a sign or cause the same to be done, or effect a substantial change to an existing sign without obtaining a permit from the Community Development Department prior to installation of or substantial change to the sign, unless the sign is specifically excluded by Sections 20.10.090 or 20.10.100 of the Edmonds City Code. Prior to issuance of the permit, all signs required to have a permit must be reviewed by the ADB as set forth in Section 20.10.030(1) of the Edmonds City Code. Prior to issuance of the permit, the applicant shall furnish any additional information deemed necessary by the Community Develop- ment Department to determine compliance with this Chapter in addition to that supplied on application forms provided by the Department." -2- Section 3.
