Ordinance 1585ORDINANCE NO._L5:&f_ AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON CREATING A NEW SECTION TO THE SEWER CODE OF THE EDMONDS CITY CODE, BEING SECTION 11.16.176, PROVIDING FOR INCREASED UTILITY CHARGES FOR SINGLE FAMILY RESIDENTIAL STRUCTURES WITH UN- AUTHORIZED CONNECTION TO THE SANITARY SEWERAGE SYSTEM. WHEREAS, certain structures within the City of Edmonds at the present time drain waters other than sanitary sewerage discharge into the sanitary sewerage system maintained by the City of Edmonds thereby contributing to overburdening the sewerage treatment plant, and WHEREAS, in some circumstances it will be difficult for various reasons to dispose of the water drainage other than into the sanitary sewerage system, and WHEREAS, in those circumstances after investigation by the Department of Public Works it is recognized that such connection may be unavoidable, and WHEREAS, in such circumstances as set forth above in order to alleviate the difficulty of disconnection while at the same time providing a contribution to cost of opera- ting the sewage disposal plant, now,therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON DO ORDAIN AS FOLLOWS: There is hereby created a new section in the Edmonds City Sewer Code reading as follows: Section 11.16.176 Addition to utility charge. In the event any single family residential structure at the time of passage of this Section contains an unauthorized connection to the sewerage system as prohibited by Section 11.16.175, the Public Works Department may send notice to correct such violation to the owner of the premises by certified mail addressed to the street address of the premises, and where the records of the Water -Sewer Department show a different address for the owner, a copy of the notice shall be mailed by certified mail to that street address. In the event such condition has not been corrected within the period specified by the Public Works Department, not less than sixty (60) days, from the date of mailing of said notice and/or notices to correct, there shall be added to the utility bill prescribed by Chapter 6.20 of the Edmonds City Code for that premises an additional charge of $1.00 for each month of violation after the expiration of said specified period, but in no case less than sixty (60) days. Said additional charge shall continue and be collected until such time as the owner of said premises corrects or causes said condition to be corrected.
