Ordinance 254212/10/85 WSS/naa ORDINANCE NO. 2542 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING SECTION 2.35.040 COMPENSATING TIME TO RETURN TO PRIOR RULES RELATING TO THE USE OF SUCH BENEFIT AND FIXING A TIME WHEN THE SAME SHALL BE EFFECTIVE. WHEREAS, the City of Edmonds amended its provisions regarding the use and accumulation of compensatory time in order to comply with the then applicable Fair Labor Standards Act (FLSA) limitations, and WHEREAS, said FLSA has been amended to permit greater latitude in the use of compensatory time and to recognize policies in effect on April 15, 1986, and WHEREAS, the City Council desires to return to its previously established rules and to afford them full recognition under the terms of the Act, now, therefore, FOLLOWS: THE CITY COUNCIL OF EDMONDS, WASHINGTON, DO ORDAIN AS Section 1. Section 2.35.040 of the Edmonds City Code is hereby amended to read as follows: Section 2.35.040 COMPENSATING TIME When work beyond regular hours for any employee, including department heads and assistant department heads, is required of an employee by the City, compensating time off may be allowed as City requirements will permit and subject to the following requirements: 1. Non-exempt, nonrepresented employees, if they request, may be allowed, at the City's option, compensating time off at one and one-half times - 1 - the overtime worked; provided that such employee may not accumulate more than 40 hours of compensating time and that any compensating time off earned must be used within the twelve-month period following the date on which overtime is worked. 2. All employees other than specified in Section 1 above, shall be allowed compensating time off equal to the amount of overtime worked. The compensating time off must be used within the twelve month period following the date of overtime worked and all rules regarding limitation on use imposed by subparagraph 1 shall be followed. 3. Compensating time shall be taken at the convenience of the City. All compensating time must be recorded and then approved by the employee's supervisor and/or Department Head. The Mayor will approve compensating time of Department Heads. 4. Upon termination no exempt employee shall be paid for unused compensating time. Non-exempt employees shall be paid for unused compensating time at one and one-half times the overtime worked. However, every effort should be made to use compensating time before termination. Section 2. This ordinance, being an administrative acction, is not subject to referendum and shall take effect five (5) days after its publication in the City's official newspaper.
