Ordinance 2122ORDINANCE NO. 2122 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING SECTION 11.02.035 OF THE EDMONDS CITY CODE TO ALLOW A 48 FOOT HIGH MAXIMUM BUILDING HEIGHT FOR PETROLEUM STORAGE TANKS THAT ARE A PART OF A PETROLEUM PRODUCTS STORAGE AND DISTRI- BUTION FACILITY. WHEREAS, the following amendment is in the best interest of the public health, safety and general welfare, and WHEREAS, the City Council concurs in the findings of the City's Responsible Official that there will be no signifi- cant adverse environmental impacts, now, therefore THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 11.02.035 of the Edmonds City Code is hereby amended to allow a 48 foot maximum height for petroleum storage tanks that are part of a petroleum products storage and distribution facility and to read as follows: "11 _ 02 _ 035 HRT(;HT nF RTTTT,T)TN(.S - GF.r.TTON C;n7 nF THP.. TTNTFORM rOr)F. _ Section 507 of the Uniform Building Code as adopted by reference under Section 11.02.010 of this Chapter is amended as set forth follows: 'The maximum height of every building shall not exceed a height of 3 stories or in any case 35 feet in height, provided, however, that hospitals as defined in Section 12.12.090 of the Edmonds City Code and RCW 7.41.020, and licensed as acute care hospitals by the State Department of Health, which are fully sprinklered, may be built to a maximum building height of 115 feet, subject to a grant of a Conditional Use Permit by the Board of Adjustment of the City of Edmonds; provided further, that petroleum storage tanks that are part of -1- a petroleum products storage and distribution facility may be built to a maximum building height of 48 feet."' Section 2. This Ordinance shall be in full force and effect five (5) days after passage and publication by posting as provided by law. APPROVED: MAYOR, H. H.
