Ordinance 25660006. WSS/naa 04/30/86 ORDINANCE NO. 2566 FOLLOWS: AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING CHAPTER 4.72 ECC BY THE ADDITION OF A NEW SECTION 4.72.023 TO PROVIDE FOR REGISTRATION OF BED AND BREAKFAST ESTABLISHMENTS EXEMPT FROM BUSINESS LICENSING WITH THE FIRE MARSHAL, AND MAKING THE FAILURE TO DO SO A MISDEMEANOR; AMENDING SECTION 5.50.020, SUBSECTION D, BY THE ADDITION OF A NEW SUBPARAGRAPH (3) TO PROVIDE FOR A PENALTY FOR VIOLATION THEREOF AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. THE CITY COUNCIL OF EDMONDS, WASHINGTON, DO ORDAIN AS Section 1. ECC Chapter 4.72 Business License is hereby amended by the addition of a new section 4.72.023 Registration of Transient Accommodations to read as follows: 4.72.023 Registration of Transient Accommodations It shall be unlawful for any person, partnership or corporation to operate a bed and breakfast establishment or other form of transient accommodation without first registering such accommodation with the City's Fire Marshal. "Transient accommodation" shall mean any hotel, motel, condominium, resort or other facility regardless of size which offers rental of one or more lodging units on a daily or weekly basis. It shall not include rooms let on a month -to -month leases or longer tenancies. Application for a business license shall satisfy the requirements of this section; any transient accommodation exempt from the provisions of this Chapter shall register in writing with the Fire Marshal on a form designated for use by the Fire Marshal. Violations of this section shall be punishable by a fine of Twenty Dollars ($20.00); each and every day of violation shall constitute a separate offense. Section 2. ECC section 5.50.020, subsection D is hereby amended by the addition of a new subparagraph 3 relating to the penalty for violation of ECC 4.72.023 to read as follows: 5.50.020 PENALTIES D. Any person violating any of the following sections of the City Code or Community Development Code shall be guilty of a misdemeanor and upon conviction thereof be punished as specifically provided in such section or chapter: 1. Section 17.80.030, Planter Maintenance, with penalties as provided in Section 17.80.050. 2. Section 5.17.090, Unlawful Issuance of Checks or Drafts. 3. Section 4.72.023, Registration of Transient Accommodations. Section 3. This ordinance, being an administrative action, is not subject to referendum and shall take effect five (5) days after publication.
