Ordinance 2155WDT/al 7/24/80 ORDINANCE NO. 2155 AN ORDINANCE OF THE CITY OF EDMONDS, WASH- INGTON, ADDING SECTIONS 8.48.300 - .410 TO THE EDMONDS CITY CODE, DEALING WITH PAY PARKING LOTS; DEFINING TERMS; PROHIBITING PARKING IN PAY PARKING LOTS WITHOUT PAYMENT; AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO ESTABLISH PAY PARKING LOTS; IMPOSING PEN- ALTIES, AND DECLARING AN EMERGENCY. THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. A new section 8.48.300 is hereby added to the Edmonds City Code to read as follows: "8.48.300 PAY PARKING LOT DEFINED. For the purposes of this chapter, 'Pay Parking Lot' means any parking lot owned or operated by the City of Edmonds, equipped with pay parking meters, which is designated by appro- priate signs as a pay parking lot." Section 2. A new section 8.48.310 is hereby added to the Edmonds City Code to read as follows: "8.48.310 PAY PARKING METER DEFINED. As used in this chapter, 'Pay Parking Meter' means a mechanical device or meter placed in a pay parking lot, designed so that upon payment of a specified sum of money it will dis- pense parking stubs which will authorize a vehicle to park in one stall of a pay parking lot for a specified period of time." Section 3. A new section 8.48.320 is hereby added to the Edmonds City Code to read as follows: "8.48.320 PAY PARKING STALL DEFINED. As used in this chapter, 'Pay Parking Stall' means a space in a pay parking lot designated by appropriate markings as a parking space." Section 4. A new section 8.48.330 is hereby added to the Edmonds City Code to read as follows: -1- 118.48.330 MONTHLY PARKING PERMITS. Monthly parking permits shall be obtained from the City Clerk upon payment of a $15 fee. The permit shall contain the permit number and the expiration date. When issued by the City Clerk, the monthly parking permit shall authorize a vehicle to park in a pay parking lot for a 30 day period ending on the expiration date set forth on the permit." Section 5. A new section 8.48.340 is hereby added to the Edmonds City Code to read as follows: "8.48.340 PAYMENT REQUIRED. No person shall park a vehicle in a pay parking stall, unless a parking stub is obtained from a pay parking meter by deposit of sufficient number of United States coin or coins or a monthly parking permit is obtained from the City Clerk and the parking stub or monthly parking permit is placed face side up on the front dashboard or other similar portion of the motor vehicle such that it is clearly visible from the outside." Section 6. A new section 8.48.350 is hereby added to the Edmonds City Code to read as follows: "8.48.350 OVERTIME PARKING PROHIBITED. No person shall park a vehicle in a pay parking space for a period of time longer than the period authorized by the monthly parking permit or the parking stub or stubs obtained from a pay parking meter as specified in this chapter. Each subsequent 2 hour period of time lapsing following affixing of a notice of overtime parking to a vehicle shall constitute a further violation of this section." Section 7. A new section 8.48.360 is hereby added to the Edmonds City Code to read as follows: "8.48.360 SLUGS PROHIBITED. No person shall deposit or cause to be deposited in any pay parking meter any slug, button or any other device or substance as a substitute for coins of the United States." Section 8. A new section 8.48.370 is hereby added to the Edmonds City Code to read as follows: -2- "8.48.370 TAMPERING PROHIBITED. No person shall deface injure, tamper with, open or break, destroy or impair any pay parking meter." Section 9. A new section 8.48.380 is hereby added to the Edmonds City Code to read as follows: "8.48.380 DESIGNATION OF PAY PARKING LOTS. The Direc- tor of Public Works is authorized to designate pay parking lots, purchase and install all appropriate pay parking meters, designate certain pay parking stalls for monthly parking permit only, and erect suitable signs advising the public of the requirements of pur- chasing monthly parking permits from the City Clerk or parking stubs from pay parking machines." Section 10. A new section 8.48.390 is hereby added to the Edmonds City Code to read as follows: "8.48.390 PLACEMENT OF PARKING STUBS. Monthly parking permits and parking stubs obtained from pay parking machines shall be valid only when placed face side up on the front dashboard or other similar portion of a vehicle such that they are clearly visible from the outside. Failure to place a monthly parking permit or parking stub in the manner specified in this section shall invalidate the authorization to park for the time otherwise designated on the parking permit or stub." Section 11. A new section 8.48.400 is hereby added to the Edmonds City Code to read as follows: "8.48.400 RESERVED PARKING SPACES. Purchase of a parking stub from a pay parking meter shall not be construed as reserving a pay parking stall for a vehicle. Vehicles displaying valid monthly parking permits shall be entitled to park in pay parking stalls spe- cially designated by the Director of Public Works for permit parking only. No person shall park a vehicle in a pay parking stall specially designated for permit parking only unless a valid monthly parking permit is displayed as set forth in this chapter." Section 12. A new section 8.48.410 is hereby added to the Edmonds City Code to read as follows: -3- "8.48.410 ALTERATION PROHIBITED. It is unlawful for any person to alter a monthly parking permit or parking stub in any way, such as to extend the period of park- ing time authorized, or to place a ficticious parking stub or monthly parking permit in place of or as a substitute for a monthly parking permit or parking stub to be obtained from a pay parking meter as specified in this chapter." Section 12. The provisions of this ordinance shall be enforced as provided in Section 8.48.200 - .220 of the Edmonds City Code. Vehicles parked overtime or other- wise parked in violation of this Chapter shall be subject to impoundment as provided in this Title. Section 13. If any section, subsection, word or phrase of this ordinance is held invalid by a court of com- petent jurisdiction, the remaining portions of this ordi- nance shall not be affected. Section 14. The City Council finds that there is a great demand for parking space in the City parking lot and that this public emergency ordinance is necessary for traffic control, and the protection of the public safety and welfare. This ordinance, having been passed by at least a majority plus one of the whole membership of the Council shall become effective immediately after passage. APPROVED: , MAYOR, H. H.
