ORDINANCE NO. 2601
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
VACATING A THIRTY FOOT (30') PORTION OF THE
DEDICATED BUT UNBUILT RIGHT-OF-WAY OF 81ST
AVENUE WEST
WHEREAS, pursuant to the petition of the abutting
property owner and following review and recommendation of its
Hearing Examiner, the City Council of the City of Edmonds held a
public hearing on October 21, 1986, to consider the proposed
vacation of the dedicated but unbuilt right-of-way of 81st Avenue
West in the City of Edmonds, Washington, more particularly
described as set forth on Exhibit A, attached hereto and
incorporated by reference as fully as if herein set forth, and
WHEREAS, pursuant to the finding of the City's
Responsible Official, the City Council finds that there will be
no significant adverse environmental impacts, and
WHEREAS, at the conclusion of said public hearing, the
City Council found that said property dedicated for street
purposes should be vacated upon payment of the sum of $2,493.00
by the owner of Lot 10 of Seaview Village of the City of Edmonds
without the need for a reservation of an underground utility
easement, the City Council does hereby determine to vacate the
same as hereinafter set forth, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The following parcel of property previously
dedicated for street purposes is hereby vacated. Said parcel is
located in the City of Edmonds, Snohomish County, Washington,
adjacent to Lot 10 of Seaview Village and is generally described
as thirty foot (301) by thirty foot (301) portion of the
dedicated but unbuilt right-of-way of 81st Avenue West, as
legally described and shown on Exhibit A hereto which is
incorporated by reference as fully as if herein set forth, said
vaction being made in favor of the current and future owners of
Lot 10, Seaview Village according to the plat thereof.
Section 2. The City Clerk is hereby directed to file a
certified copy of this ordinance with the Snohomish County
Auditor, and receipt of the sum of Two Thousand Four Hundred
Ninety -Three Dollars ($2,493) from Tom Snyder, owner of said Lot
10, Seaview Village, is hereby acknowledged.
Section 3. This ordinance, being an exercise of a
power specifically delegated to the City legislative body, is not
subject to referendum, and shall take effect five (5) days after
passage and publication.
