ORDINANCE NO. 2632
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, VACATING A TWENTY FOOT (20') WIDE
ALLEY LOCATED BETWEEN LOTS 1,2,3, AND 4 AND
LOTS 37, 38, 39, AND 40 OF BLOCK 122, PLAT OF
THE CITY OF EDMONDS, DEDICATED FOR STREET
PURPOSES AND FIXING A TIME WHEN THE SAME SHALL
BE EFFECTIVE.
WHEREAS, pursuant to a certified petition of the abutting
property owners and following review and recommendation of its
Hearing Examiner, the City Council of the City of Edmonds held a
public hearing on August 6, 1985, to consider the proposed
vacation of certain property in the City of Edmonds, Washington,
dedicated for street purposes and located between Lots 1, 2, 3,
and 4 and Lots 37, 38, 39, and 40 of Block 122, Plat of the City
of Edmonds, more particularly described as set forth on Exhibit A,
attached hereto and incorporated by reference as fully as if
herein set forth, and
WHEREAS, pursuant to the finding of the City's
Responsible Official, the City Council finds that there will be no
significant adverse environmental impacts, and
WHEREAS, at the conclusion of said public hearing, the
City Council found that said property dedicated for street
purposes should be vacated upon payment of the sum of $18,255.00
by the abutting property owners and reservation of an underground
utility easement, and

WHEREAS, the applicant has requested that the amount of
compensation be reduced to $14,000 to reflect the cost of utility
relocation, and the Council deems such reduction to be
appropriate, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The following parcel of property previously
dedicated for street purposes is hereby vacated subject to the
City's reservation of an easement to construct, repair, and
maintain underground public utilities. Said parcel is located in
the City of Edmonds, Snohomish County, Washington, between Lots 1,
2, 3, and 4 and Lots 37, 38, 39, and 40 of Block 122 of the Plat
of the City of Edmonds, as legally described and shown on Exhibit
A hereto, which is incorporated by reference as fully as if herein
set forth.
Section 2. The City Clerk is hereby directed to file a
certified copy of this ordinance with the Snohomish County Auditor
upon, but only upon full payment by the abutting property owners
of the sum of Fourteen Thousand Dollars ($14,000.00).
Section 3. This ordinance, being an exercise of a power
specifically delegated to the City legislative body, is not
subject to referendum, and shall take effect five (5) days after

passage and publication of the attached summary which is hereby
approved.
