AN ORDINANCE VACATING A PORTION OF AN
UNNAMED RIGHT-OF-WAY NEAR ANDOVER STREET
IN THE CITY OF EDMONDS, WASHINGTON,
RETAINING AN EASEMENT AND RESERVING TO
THE CITY OF EDMONDS THE RIGHT TO EXERCISE
AND GRANT EASEMENTS THEREON FOR PUBLIC
UTILITIES AND SERVICES.
WHEREAS, a petition to vacate a right-of-way was filed
with the City Council of the City of Edmonds, signed by the
owners of more than two thirds of the property abutting upon
the property dedicated for right-of-way purposes, located in the
City of Edmonds, being a portion of an unnamed right-of-way
near Andover Street, more particularly described below, and
WHEREAS, the City Clerk having returned a certificate of
sufficiency of said petition, and
WHEREAS, the City Council of the City of Edmonds did, by
Resolution No. 316 of said City, duly adopted on the lst day
of October, 1974, set the 5th day of November, 1974, at the
hour of 7:30 p.m. of said day, for the hearing and determination
on said vacation, and
WHEREAS, it appears to the City Council that said portion
of the unnamed right-of-way near Andover Street should be
vacated and the said City Council does hereby determine to
vacate the same, as hereinafter set forth,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS,
WASHINGTON, DO ORDAIN AS FOLLOWS:
That the following described unnamed right-of-way near
Andover Street in the City of Edmonds, Snohomish County,
Washington, legally described as follows:
The West 25.00 feet of the following: Part
of the northwest quarter of the northeast
quarter of Section 18, Township 27 North,
Range 4 East, W.M., described as follows:
Beginning at the northwest corner of said
northwest quarter of the northeast quarter;
thence south 89056' E, along the north line
of the section, 550.00 feet to the west
margin of Andover Street as shown on plat
of the First Addition to the City of Edmonds,
according to plat thereof recorded in Volume
2 of Plats, Page 31, records of Snohomish
County, Washington; thence south 0*11' east
along said west margin of Andover Street,
345 feet to the true point of beginning of
this description; thence from said point of
beginning, run north 0*11' west 345 feet to
the north line of the section; thence north
89*56' west along the section line 270.00
feet to the centerline of that certain ease-
ment described in Declaration of Easement
filed for record under Auditor's File No.
1614380; thence south 100.00 feet; thence
south 20000' west 100.00 feet; thence south
14026'30" E 97.04 feet; thence south 16154'51"
W 59.00 feet, more or less, to intersect a
line running north 89°56' W from the point of
beginning; thence south 89*56' E 300.00 feet,
more or less, to the point of beginning;
EXCEPT therefrom a strip of land 10.00 feet
wide east of and abutting upon the west
line of said premises.
be and the same is hereby vacated, provided, that the City of
Edmonds does hereby retain an easement and reserves the right
to exercise and grant easements in respect to said vacated
land for the construction, repair and maintenance of public
utilities and services.
