AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON
AMENDING SECTION 12.10 .0 50 ( 2 ) (d) BY ADDING A
NEW SUBSECTION (6) PERMITTING ADJUSTMENT OF
SIDE YARD SETBACKS WHERE SUCH WILL CONTRIBUTE TO
THE PRESERVATION OF EXISTING TREES.
WHEREAS, the City Council of the City of Edmonds,
Washington, pursuant to Planning Commission Resolution No. 466,
called a public hearing, and having during said hearing,
determined it to be in the best interest of the public health,
safety, and welfare to amend the Edmonds Zoning Ordinance,
particularly the subdivision code, as set forth below, in
modification of Planning Commission Resolution No. 466, and
WHEREAS, it is recognized that the amendment as set
forth hereinafter will contribute to the preservation of
desirable characteristics of the city, provide for greater
interest in subdivision development, contribute a better means
of adapting subdivision development to natural conditions and
contribute to the preservation of existing wooded areas, now,
therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
A new subsection (6) is hereby added to section 12.10.050
(2) (d) to read as follows:
"12.10.050(2)(d)(6) The applicant may request
adjustment in side yard setback regulations in
accordance with the table set forth hereinbelow
for the applicable zones only where existing
trees would be preserved by adjusting the
allowable building area. In the event of
adjustments under this subsection, side yard
setback requirements shall conform with the
following table:

* Provided however, no two structures on separate
adjacent lots may be closer together than the
sum of the side yard setbacks as set forth above.
This restriction together with any adjustment
in side yard setback requirements that have been
approved, shall appear on the face of the plat.
