Ordinance 1778ORDINANCE NO. 1778 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE OFFICIAL ZONING ORDINANCE OF SAID CITY TO ESTABLISH PROVISIONS FOR SOCIAL SERVICE FACILITIES, WITH AMENDMENTS TO SECTIONS 12.12.040 C TERMS; 12.12.060 E TERMS; 12.12.070 F TERMS; 12.12.100 I TERMS; 12.13.040 SECONDARY USES IN RS DISTRICTS; 12.13.070 PRIMARY USES IN RD DISTRICTS; 12.13.110 PRIMARY USES IN RM DISTRICTS; 12.13.150 PERMITTED USES IN BN DISTRICTS; 12.13.270 PERMITTED USES IN CG DISTRICTS; AND ADDING A NEW SECTION 12.16.075 TABLE OF ZONE REQUIREMENTS FOR SOCIAL SERVICE FACILITIES, PURSUANT TO PLANNING COMMISSION RESOLUTION NO. 462. WHEREAS, the City Council of the City of Edmonds, Wash- ington, pursuant to Planning Commission Resolution No. 462, called a public hearing, and having during said hearing determined it to be in the best interests and the public health, safety and welfare to amend the Edmonds Zoning Ordinance as set forth below, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. Section 12.12.040 "(C) Terms," of the Edmonds City Code is hereby amended by adding a new term, "CRISIS CENTERS," to read as follows: "12.12.040 (C) Terms. CRISIS CENTERS - A social service facility which provides 24-hour accessi- bility for temporary residential or counseling services excluding hospital emergency services or facilities which provide telephone services only." Section 2. Section 12.12.060 "E Terms," of the Edmonds City Code is hereby amended by adding a new term, "EDUCATIONAL INSTITUTION," to read as follows: "12.12.060 E Terms. EDUCATIONAL INSTITUTION - "Educational institution" means a college, community college or university supported by public or private funds, tuitions, contributions or endow- ments, giving advanced academic instructions as approved by the state board of education or by recognized accredition agency, excluding preschool, and elementary, junior and senior high schools, and trade and commercial schools; including fraternity and sorority houses." Section 3. Section 12.12.070 "F Terms," of the Edmonds City Code is hereby amended by adding a new term, "FOSTER HOMES," to read as follows: 1112.12.070 F Terms, FOSTER HOMES - A social service facility licensed by the State as a full-time foster family and described as an agency that regularly provides care on a 24-hour basis to one or more, but not more than six foster children, under the age of 18 years or to not more than 3 expectant mothers in the family dwelling of the person or persons under whose direct care and supervision the child or expectant mother is placed." Section 4. Section 12.12.100 "I Terms," of the Edmonds City Code is hereby amended to read as follows: "12.12.100 I Terms. INSTITUTION, EDUCATIONAL - Refer to Section 12.12.060 E Terms." INSTITUTION, SOCIAL SERVICE - Refer to Section 12.12.200 S Terms." Section 5. Section 12.12.200 "S Terms," of the Edmonds City Code is hereby amended by adding new terms, "SOCIAL SERVICE FACILITY" and "SOCIAL SERVICE INSTITUTION," to read as follows: "12.12.200 S Terms. SOCIAL SERVICE FACILITY - A facility which functions at the community level as part of public, private, charitable, pro- prietary, or voluntary program to assist persons in difficulty or need either by providing basic health, education and welfare services or by providing correctional or rehabili- tative services excluding foster homes as defined in this chapter or individuals licensed by the Department of Professional Licensing of the State or admitted to the Washington State Bar Association. A residential social service is a facility that provides temporary or permanent overnight care. Day services are those provided during regular daily hours only. (Permitted Social Service Facilities are listed in "Table of Zone Reguirements for Social Service Facilities" Section 12.16.075). SOCIAL SERVICE INSTITUTION - A social service facility licensed by the State of Washington to provide professional services and residential care for more than 10 persons who are mentally retarded, handicapped, or wards of the court under the age of 18 years excluding penal institutions or residential facilities for rehabilitation of drug addicts or alcoholics or work release centers. Section 6. Section 12.13.040 (f) of the Edmonds City Code is hereby amended to read as follows: "12.13.040 Secondary Uses in RS Districts. (f) Day nurseries, child care centers, preschools and private kindergartens, subject to grant of conditional use permit and Statement of Operating Conditions provided there is established and maintained in connection therewith, a fenced play lot on the premises, with a minumum area of four hundred square feet in size, plus an additional forty square feet for each child in excess of ten in number, and subject to the regulations of the State Welfare Department. Appeal procedures for rehearing shall be as provided in Section 12.13.110(L)(8). Section 7. Section 12.13.040 of the Edmonds City Code is hereby amended by adding a new section, (j) to read as follows: "12.13.040 (j) Foster Homes. Foster homes with not more than the number of persons permitted by definition of a 'family' as defined in Chapter 12.12.)" Section 8. Section 12.13.070 (d) of the Edmonds City Code is hereby amended to read as follows: "12.13.070 Primary Uses in RD Districts. (d) Day nurseries, child care centers, preschools and private kindergartens, subject to grant of conditional use permit and Statement of Operating Conditions, provided there is established and maintained in connection therewith, a fenced play lot on the premises, with a minimum area of four hundred square feet in size, plus an additional forty square feet for each child in excess of ten in number, and subject to the regulations of the State Welfare Department." Appeal procedures for rehearing shall be as provided in Section 12.13.110(L)(8). Section 9. Section 12.13.110 (k) of the Edmonds City Code is hereby amended to read as follows: "12.13.110 Primary Uses in RM Districts. (k) Day nurseries, child care centers, preschools and private kindergartens, subject to grant of conditional use permit and Statement of Operating Conditions, provided there is established and maintained in connection therewith, a fenced play lot on the premises, with a minimum area of four hundred square feet in size plus an additional forty square feet for each child in excess of ten in number, and subject to the regulations of the State Welfare Department. Appeal Procedures for rehearing shall be as provided in Section 12.13.110(L)(8). Section 10. Section 12.13.110 of the Edmonds City Code is hereby amended by adding the following subsections (m) and (n): "12.13.110 Primary Uses in RM Districts. (m) Social Service Institutions, with minimum lot size of one acre and subject to grant of a conditional use permit based on the criteria defined in Section 12.13.110(L) "Group Homes". Appeal procedures for rehearing shall be as provided in Section 12.13.110(L)(8). (n) Social Service Facilities providing day services only and subject to grant of conditional use permit and Statement of Operating Conditions. Appeal procedures for rehearing shall be as provided in Section 12.13.110(L)(8). (1) Counseling for drug and alcohol rehabilitation. (2) Community Centers providing counseling, referral and family services. (3) Community mental health clinics or outpatient services. Section 11. Section 12.13.150 (B) of the Edmonds City Code is hereby amended by adding the following subsection(3) to read as follows: "12.13.150 Permitted Uses in BN Districts. (3) Social Service Facilities providing day services only and crisis centers providing 24 hour accessibility subject to grant of conditional use permit and Statement of Operat- ing Conditions. Appeal procedures for rehearing shall be as provided in Section 12.13.110(L)(8). Section 12. Section 12.13.270 of the Edmonds City Code is hereby amended by adding a new section (35), to read as follows: "12.13.270 Permitted Uses in CG Districts (35) Social Service Facilities providing day services only, subject to grant of conditional use permit and Statement of Operating Conditions. Appeal procedures for rehearing shall be as provided in Section 12.13.110(L)(8). Section 13. A new Section 12.16.075 Table of Zone Require- ments for Social Service Facilities, is hereby added to Edmonds City Code to read as follows: The Table of Zone Requirements for Social Service Facilities attached hereto, identified as Exhibit "A", is hereby incorporated by this reference as if set forth in full.
