Ordinance 1781� C10 7 \ C ca ORDINANCE NO. 1 781 : st AN ORDINANCE ORDERING THE IMPROVEMENT OF CERTAIN tt PROPERTY IN THE CITY OF EDMONDS BY THE CONVERSION ;mod OF OVERHEAD ELECTRIC AND COMMUNICATION FACILITIES r o TO UNDERGOUND FACILITIES AND ALL RELATED WORK t ci NECESSARY TO MAKE A COMPLETE IMPROVEMENT IN tS a �� ACCORDANCE WITH APPLICABLE CITY STANDARDS; CREATING AN ASSESSMENT DISTRICT BEING LOCAL ro V IMPROVEMENT DISTRICT NO. 195 PROVIDING THAT ��� PAYMENT OF SAID IMPROVEMENT SHALL BE MADE FROM w g ;w FUNDS AVAILABLE TO THE CITY OF EDMONDS �Co_a o WHEREAS, it is in the interest of the public healtulm o N safety, and general welfare, that overhead utilities, including electric and communication facilities be under - grounded on heavy traffic arterial approaches to said City and the City Council so finds that the poles and other structures used to support said overhead facilities are an obstruction to pedestrian traffic and may constitute a hazard to vehicles leaving the travelled portion of the roadway which can and may be removed by the undergrounding of such facilities, and WHEREAS, the public health, safety, and general welfare will be served not only from the safety standpoint, but also from an aesthetic viewpoint by the removal of such view obstructing and unsightly overhead apparatus and lines, and WHEREAS, the undergounding of such facilities will result in less costly and easier maintenance to the owners of said facilities, now, therefore, WHEREAS, the City Council is proposing and stating its intent to construct a major improvement on that portion of 5th Avenue South from the northerly right-of-way line of SR 104 to and including its intersection with Main Street which improvement will include the construction, reconstruc- tion and repair of concrete sidewalks, curbs, gutters driveways across said sidewalks, landscaping and possible resurfacing of said street, and related work necessary to make a complete improvement and that said overhead electric and communication facilities should be undergrounded at this time in conjunction with said improvement to minimize the expense to the companies presently maintaining said facilities and to minimize the effect of such undergrounding at a future time on a completed improvement of this nature, WHEREAS, the City Engineers have caused an estimate to be made of the cost and expense of the proposed improvement and have certified said estimate to the City Council, a description of the boundaries of the district, a statement in detail of the local improvement assessments outstanding or unpaid against the property under the proposed district, and a statement of the aggregate actual value of the real property, including twenty-five percent of the actual evalua- tion of the improvement in the proposed district, according to the valuation last placed upon it for the purpose of general taxation, and WHEREAS, the City Council deems this in the best interest of the City and of the owners of the property within the :local improvement district that said improvement, is herein- after described, be carried out and that a local improvement district be created in connection therewith, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The following property within the City of Edmonds, Washington is hereby ordered to be improved by the conversion of overhead electric and communication facilities to underground facilities, including electrical energy transmission, telephone lines, cable television coaxial and related lines, street _lighting systems, and the necessary street and right-of-way invasion, trenching, back -filling, relocation and removal of said overhead facilities, restora- tion of disturbed facilities including those on public and private property, necessary manholes for transformer vaults, or in the alternative surface mounted transformers depending upon economic exigencies and design necessities, the installa- tion of necessary pedestals and lighting ornamental poles or standards, and all related work necessary to make a complete improvement, in accordance with applicable city and electrical and communication facilities standards, as follows: 5th Avenue South from the northerly right-of-way line of State Route 104 to and including its intersection with Main Street. The foregoing shall be carried out in accordance with the maps, plans and specifications therefor prepared by the respective electric utility and communication facilities distributors, districts and companies as submitted to the City Engineer and under his approval and authorization and the same are hereby adopted. Section 2. There is hereby created and established a local improvement district to be called "Local Improvement District No. 195," the boundaries of which are described by Exhibit "A" a copy of which is attached hereto and by this reference incorporated herein as if set forth in full. Section 3. The nature of the improvement is such that the special benefits are conferred on the properties that abutt on the improvement. That there shall be no assessments against the abutting properties as the costs and expenses of said improvement, not including service line removal and installation and disconnection from existing overhead facilities which shall be provided by the individual property owners, shall be paid from monies available to the City of Edmonds and participation by the participating electrical and communication distributors, utility districts and companies and by the contractural arrangements for services and supplies with said organizations or pursuant to applicable franchises or other ordinances of the City. Section 4. The estimated cost and expense of said improve- ment lying within the proposed district is hereby declared to be $223,755.00, plus service line removal and connection and disconnection from existing overhead facilities. The cost and expenses of said improvement, including all labor and materials required to make a complete improvement, all engineering, surveying, legal, inspection, ascertaining of ownership of the lots or parcels of land included in the district, adver- tising, mailing and publication of notices, accounting, administrative, printing, costs of acquisition, and other expenses incidental thereto shall be paid for in the manner set forth hereinabove. Section 5. All the work necessary to be done in connec- tion with the making of said improvement, except service line removal and connection and disconnection from the existing overhead facilities, shall be done by the respective electric utility and communication distributors pursuant to contracts with the City of Edmonds or other applicable franchise or ordinance of said City, and pursuant to the revised Code of Washington, Chapter 35.96. Section 6. The improvement to be accomplished pursuant to this Ordinance requires undergrounding of the communication facilities located in, upon and along the public right-of-way on Fifth Avenue South from SR 104 to its intersection with Main Street pursuant to Ordinance No. 1780 passed on July 22, 1975. General Telephone of the Northwest is hereby ordered and directed to coordinate the removal of and undergrounding of its existing aboveground facilities along said improvement with construction of said improvement.
