Ordinance 28610006.030.051 MHD/srh/klt 01/02/91 ORDINANCE NO. 2861 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, IMPOSING A REGULAR PROPERTY TAX LEVY FOR EACH OF THE YEARS 1992 THROUGH 1997 TO BE COLLECTED IN 1993 THROUGH 1998 WITH SPECIFIC LEVY AMOUNTS TO BE LIMITED BY RCW CHAPTER 84.52 AND ESTABLISHED IN THE ANNUAL BUDGET PROCESS; EACH LEVY SHALL NOT EXCEED THE RATE OF $.45 PER ONE THOUSAND DOLLARS OF THE THEN CURRENT ASSESSED VALUE OF ALL PROPERTY WITHIN THE CITY, PURSUANT TO AUTHORITY GRANTED BY RCW SECTION 84.52.069; THE REVENUES OF SAID LEVIES TO BE USED FOR THE PROVISIONS OF EMERGENCY MEDICAL CARE AND EMERGENCY MEDICAL SERVICES, ALL SUBJECT TO APPROVAL BY THE QUALIFIED ELECTORS OF THE CITY; AND PROVIDING FOR THE SUBMISSION OF THE PROPOSITION FOR SAID SIX YEAR LEVY FOR EMERGENCY MEDICAL CARE AND SERVICES TO THE QUALIFIED VOTERS OF THE CITY AT A SPECIAL ELECTION TO BE HELD ON MARCH 10, 1992 BY MAIL BALLOT PURSUANT TO RCW 29.36.120, DECLARING AN EMERGENCY, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the Washington State legislature by virtue of RCW Section 84.52.069 has authorized cities to impose an additional property tax levy of up to $.45 per One Thousand Dollars of assessed valuation to provide emergency medical care and emergency medical services in each year for six consecutive years; and WHEREAS, assuring a constant source of funds to provide such emergency medical care and services will ensure continuous provision of emergency medical care and services and thus be in the best interest of the public health, safety and general welfare; and WHEREAS, the level of funding needed to adequately provide emergency medical care and services to the citizens of the WSS10123.10 -1- City of Edmonds for each of the six consecutive years of 1992 through 1997 cannot be precisely determined due to the changing economic needs and demands of the City and the County; and WHEREAS, the assessed valuation of all property within the City for 1992 has not yet been certified to the City by the Snohomish County Assessor, and it is impossible to precisely project figures for assessed valuation for future years; and WHEREAS, it is the intent of the City Council of the City of Edmonds to seek voter approval for a levy for each of the years 1992 through 1997 to be collected in the year following each of said years, the amount of the 1992 levy and the dollar increases of the levies subsequent to 1992 to be determined in the annual budget process and governed by the need for funds to provide emergency medical care and services, limited by RCW 84.52 and not to exceed the rate of $.45 per One Thousand Dollars of the then current assessed value of all property within the City; and WHEREAS, the current lack of funding for emergency medical services constitutes a public emergency requiring immediate submission to the voters at the earliest available election date by mail ballot; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. It is hereby found and declared that an emergency exists requiring the calling of a special election, and the Auditor of Snohomish County as ex officio supervisor of elections for such County is hereby requested to find and declare WSS10123.1O -2- the existence of such an emergency. The Snohomish County Auditor is hereby further requested to call and conduct a special election in the City of Edmonds, Snohomish County, by mail ballot, in the manner provided by RCW 29.36.120 to be held therein on March 10, 1992 for the purposes of submitting to the qualified electors of the City for their approval or rejection the question of whether or not a tax levy shall be made each year for six consecutive years, commencing in 1992 to be collected in 1993 and to be assessed in each of the years 1993 through 1997 and to be collected in the years 1994 through 1998, the specific dollar amount of said levies to be determined in the annual budget process by the City Council when it determines the amount of funds needed to adequately provide for emergency medical care and services, limited by RCW 8.52 and not to exceed $.45 per One Thousand Dollars of the then current assessed valuation of all property in the City subject to taxation, said levies to be in addition to the regular tax levy provided by law for cities without the vote of the electors, the proceeds thereof to be used to pay the costs of furnishing emergency medical care and emergency medical services, including related personnel costs, training for such personnel and related equipment, supplies, vehicles and structures needed for the provision of emergency medical care and emergency medical services. This request for a mail ballot is exclusive; the Auditor is not requesting to conduct an election at the polls in conjunction with any other ballot measure. WSS10123.1O -3- Section 2. The ballot title for the aforementioned proposition shall be as follows: PROPOSITION EMERGENCY MEDICAL SERVICES - SIX YEAR LEVY To continue to fund the present 24 hour transport aid car and Medic 7 advanced life support programs, shall up to $. 45 per One Thousand Dollars of assessed valuation in excess property tax be levied by the City of Edmonds pursuant to RCW 84.52.069? rm" NO ' ' Section 3. The City Clerk is hereby authorized and directed to furnish to the Snohomish County Auditor a certified copy of this Ordinance on or before January 10, 1992. Section 4. The current lack of funding for emergency medical services is a public health emergency that requires immediate submission to the voters at the earliest available election date by mail ballot. The City Council hereby declares that an emergency exists necessitating that this ordinance take effect immediately upon passage by unanimous vote of the members of the City Council.
