Ordinance 1806ORDINANCE NO. 1806 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE OFFICIAL ZONING ORDINANCE OF SAID CITY BY AMENDING SECTION 12.12.030 TO DEFINE ALLOWABLE BUILDING HEIGHT AND ADD A NEW DEFINI- TION, BUILDING HEIGHT RECTANGLE PURSUANT TO PLANNING COMMISSION RESOLUTION NO. 479. WHEREAS, the City Council of the City of Edmonds, Washington, pursuant to Planning Commission Resolution No. 479, called a public hearing, and having during said hearing determined it to be in the best interests and the public health, safety and welfare to amend the Edmonds Zoning Ordinance as set forth below, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Definition No. 1 and 2 under BUILDING HEIGHT ALLOWABLE in Section 12.12.030 "B" Terms are hereby repealed and a new definition of BUILDING HEIGHT ALLOWABLE, is hereby adopted and added to Section 12.12.030 "B" Terms to read as follows: BUILDING HEIGHT ALLOWABLE - The vertical dimension allowed in each zoning district and/or the building code, whichever is lesser, measured from the mean elevation of the undisturbed soil as measured at the intersection of the sides of the building height rectangle or where the building height rectangle extends beyond the allowable building area an average of the elevation of undisturbed soil at the intersection of the building height rectangle with the allowable building area line will be averaged for the elevation of the point lying outside the al- lowable building area (e.g., See Fig. 1 and 2 for illustrative purposes). 1 Section 2. The term UNDISTURBED SOIL as defined in Section 12.12.030 "B" Terms is hereby amended to read as follows: UNDISTURBED SOIL - As used herein shall mean the condition of the site at the time a building permit application is made to the City and prior to any site work occurring. Provided, however, where the site has been altered by grading, cutting or filling or similar activities prior to the application for a building permit, the building official shall have the right to make the determination from then available data of the mean elevation of the undisturbed soil. If the undisturbed soil elevation is not readily determined due to demolition of an existing structure, the contours may be reconstructed by the building official to coincide with adjoining topography to determine the undisturbed soil elevations If the proposed structure occurs where no setbacks are required, the elevation of the surface (sidewalk, alley or soil) of the property line at or nearest the intersection of the sides of the building height rectangle will be considered undisturbed soil. Where the building official deems it necessary, he shall have the right to require establishment of a datum point from which all height measurements shall be made. Section 3. There is hereby added to Section_ 12..12.030 "B" Terms a new term BUILDING HEIGHT RECTANGLE to read as follows: BUILDING HEIGHT RECTANGLE - The smallest rectangle enclosing the building lines of the proposed building or structure.
