Ordinance 1818ORDINANCE NO. 1818 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING SECTION 12..13.250(E) OF THE EDMONDS CITY CODE BY ESTABLISHING THE MAXIMUM BUILDING HEIGHT FOR BUILDINGS IN THE COMMERCIAL WATERFRONT (CW) ZONE WITHIN SAID CITY IN MODIFICATION OF PLANNING COMMISSION RESOLUTION NO. 490. WHEREAS, the City Council of the. City of Edmonds, Washington, pursuant to Planning Commission Resolution No. 490, called a public hearing and during said hearing determined it to be in the best interests of the public health, safety and welfare to amend the Edmonds Zoning Ordinance as set forth below in modification of Planning Commission Resolution No. 490, and WHEREAS, The City Council having found that there is a need to further define and specify the maximum building heights for various types of buildings and uses within the commercial water- front zone of said city, particularly with respect to buildings or other structures built upon piers or other structures over the water and the Council finding that it is necessary to amend the maximum height permissible for multi -family residential buildings in said zone to bring said.code into conformance with the Shoreline Master Program of said city, now,. therefore, THE CITY COUNCIL OF THE CITY OF EDMONLS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section. 12..13. 250 (E) of the Edmonds City Code is. hereby amended to read as follows: "12..13.150'(E). Maximum Building Height. The maximum building height.for all.buildings in a CW zone,except multi -family residential buildings, shall not exceed a height of 35 feet. Multi -family residential buildings shall not exceed a height of 25 feet. Provided, however, irrespective of the maximum height permitted for any building no building shall exceed the lesser of the following: 1. No -building shall extend more than the permitted height above the: upper platform surface of any pier, dock or other structure .over the water; 2. No .building built over water shall extend more than the maximum permissible height plus eight feet.ab.ove the mean higher high water; 3. No building.shall extend more than the maximum Permissible height above the lowest elevation of the nearest adjacent street.
