ORDINANCE NO. 2876
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE PROVISIONS OF THE
INTERIM CRITICAL AREAS ORDINANCE ADOPTED AS
ORDINANCE NO. 2874 AND BY THE INSERTION OF A
SUNSET CLAUSE, AND FIXING A TIME WHEN THE SAME
SHALL BECOME EFFECTIVE.
WHEREAS, the City has adopted an interim critical areas
ordinance as ordinance no. 2874, pursuant to the direction of the
State Growth Management Act; and
WHEREAS, the City now embarks on the process of reviewing
and amending its Comprehensive Plan in order to bring it in
conformance with the Growth Management Act and the City zoning
code; and
WHEREAS, the City is mandated to then adopt a final
critical areas ordinance on or before July 1, 1994 which conforms
with its revised Comprehensive Plan; and
WHEREAS, the City Council wishes to clearly state the
interim nature of Ordinance No. 2874 by providing a sunset clause
for its automatic expiration on July 1, 1994; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Ordinance No. 2874 is hereby amended by the
insertion of a sunset clause to provide as follows:
This ordinance shall expire on July 1, 1994,
unless sooner repealed by action of the City
Council. Nothing herein shall be deemed to
amend, restrict or repeal the vesting

provisions contained in section 2 of Ordinance
No. 2874 which shall survive the sunset and/or
repeal of the interim critical areas
ordinance, Chapter 20.15B of the Edmonds
Community Development Code adopted pursuant to
section 1 of Ordinance 2874. In the event
that Ordinance No. 2874, this ordinance or any
provision thereof is held invalid, development
proceeding pursuant to such ordinance(s) shall
later be governed by the substantive
provisions of the zoning code in effect on
March 1, 1992.
Section 2. This ordinance, being an administrative
action, is not subject to referendum and shall take effect five (5)
days after this ordinance or a summary thereof consisting of the
title is published.
