Ordinance 1835ORDINANCE NO. 1835 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING SECTION 12.13..190(b) OF THE EDMONDS CITY CODE TO PERMIT AUCTIONS IN COMMUNITY BUSINESS (BC) ZONES WITHIN SAID CITY SUBJECT TO A CONDITIONAL USE PERMIT. WHEREAS, the City Council of the City of Edmonds, Washington, pursuant to Planning Commission Resolution No. 502, called a public hearing, and having during said hearing determined it to be in the best interest of the public health, safety and welfare to amend the Edmonds Zoning Ordinance as -set forth below, in modification of Planning Commission Resolution No. 502, and WHEREAS, the City Council having found .that certain types of auctions are a compatible use in the community business zone within said City but that additional regulation is needed to minimize the effect of such businesses upon locations in the general vicinity and to minimize the burden on existing parking facilities, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 12.13.190(b) is hereby amended to read as follows: "12.13`.190(b). Retail enterprises dispensing food or commodities on premises, except trailers or heavy duty equipment, and which may involve only limited and incidental assembly, repair or fabrication of goods or commodities; auction businesses, excluding vehicle and lifestock auctions, subject to the grant of a conditional use permit the review of which shall include but not be limited to the following: 1. Insure compatibility with properties in proximity; 2. Assess parking requirements in relationship to hours of operation and demand for parking facilities provided for the proposed uses; 3. The hours of operation of such auction businesses. APPROVED: MAYOR, H. H.
