Ordinance 1838ORDINANCE NO. 1838 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE TABLE OF CONDITIONAL USES CONTAINED IN EDMONDS CITY CODE SECTION 12.16.070 TO REQUIRE A CONDITIONAL USE PERMIT FOR EXCAVATIONS IN EXCESS OF 500 CUBIC YARDS AND FOR LAND FILLS, RECLAMA- TION TO IMPROVE STEEP, LOW OR OTHERWISE UNUSABLE LAND ONLY WHEN SUCH FILLS ARE IN EXCESS OF 500 CUBIC YARDS PURSUANT TO PLANNING COMMISSION RESOLUTION NO. 494. WHEREAS, the City Council of the City of Edmonds, Washington, pursuant to Planning Commission Resolution No. 494, called a public hearing, and having during said hearing determined it to be in the best interests of the public health, safety and welfare to amend the Edmonds Zoning Ordinance as set forth below, pursuant to Planning Commission Resolution No. 494, and WHEREAS, the City Council having found that requirement of a conditional use permit for excavations, land fills, reclamation to improve steep, low or otherwise unusable land which are less than .500 'cubic yards more likely than not will have little or no significant effect and do not warrant the extensive administrative procedure and process of having to obtain a conditional use permit. The City Council further finding that all land fills in excess of 50 cubic yards or more are required to obtain a permit from the building department and are reviewed by engineering, planning and building departments prior to the issuance of such permits, and the City Council further finding that such a procedure provides adequate technical and administrative review of excavations or fill of less than 500. cubic yards, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: The Table of Conditional Uses contained in Edmonds City Code, Section 12.16.070, is hereby amended to require a conditional use per- mit for excavations or land fills of 500 cubic yards or more and the Table of Conditional Uses contained in Edmonds City Code, Section 12.16.070 shall be amended to conform with Exhibit A attached hereto and hereby incorporated in full by this reference.
