Ordinance 1857ORDINANCE NO. 1857 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE NOTES TO SECTION 12.13.130 OF THE EDMONDS CITY CODE TO PERMIT UNOCCUPIED WEATHER PROTECTION,STRUCTURES TO EXTEND INTO SETBACKS IN RM ZONES SUBJECT TO CERTAIN CONDITIONS PURSUANT TO PLANNING COMMISSION RESOLUTION NO. 514. WHEREAS, the City Council of the City of Edmonds, Washington, pursuant to Planning Commission Resolution No. 514 called a public hearing, and having during said hearing determined it to be in the best interests of the public health, safety and welfare to amend the Edmonds Zoning Ordinance as set forth below, pursuant to Planning Commission Resolution No. 514, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: The notes to Section 12.13.130 of the Edmonds City Code are hereby supplemented by the addition of the following: "Unoccupied weather protection structures may extend into the required setbacks in the RM zones provided: 1. The City Engineer determines that vehicular and pedestrian safety is insured; 2. No portion of the structure extends into the public right-of-way, into public easements or over an adjoin- ing property; 3. The total site area covered by the structure in the setback area does not exceed 400 square feet; 4. Any enclosure of the structure shall only be permitted within the allowable building area; 5. Allowable height shall not exceed one story; -1- 6. The structure shall in all other respects conform to the building code requirements.
