Ordinance 28990006.030.007 WSS/are 09/08/92 ORDINANCE NO. 2899 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE PROVISIONS OF SECTION 3.20.050 OCCUPATION SUBJECT TO TAX - AMOUNTS PARAGRAPH A PUBLIC UTILITY DISTRICTS TO IMPOSE AN ADDITIONAL THREE-QUARTERS OF ONE PERCENT UTILITY BUSINESS AND OCCUPATION TAX, PROVIDING FOR THE EXPIRATION OF THE ADDITIONAL PERCENTAGE AT THE PAY OFF DATE OF CERTAIN BONDS WHOSE REPAYMENT WAS FUNDED WITH THE MONIES AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, it is deemed to be in the public interest to issue bonds for the construction of a public works facility, and WHEREAS, the City wishes to provide monies for repayment from a utility business and occupations tax but wishes to provide for automatic expiration of the additional three-quarters of one percent levied for the purpose of repayment at the date the bond obligations expire NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 3.20.050 of the Edmonds City Code, Paragraph A is hereby amended to read as follows: 3.20.50 OCCUPATION SUBJECT TO TAX - AMOUNTS, (A) Public utility districts. Upon every person, firm, corporation or other entity engaged in or carrying on the business of selling or furnishing electrical energy and power a fee or tax equal in the following WSS28750.1\0006.030.007 - 1 - percentages is levied upon the total gross income from such business within the City of Edmonds during the tax year for which the license is required: 1) A fee or tax equal to six percent. 2) Until December 31, 2013 an additional three-quarters of one percent for a total of six percent shall be levied, provided, however that the additional three-quarters of one percent shall automatically expire and be repealed on December 31, 2013. 3) Provided, however, that there shall be no tax or fee upon revenues derived from the sale of electricity for the purposes of resale. Section 2. Effective December 31, 2013, the preceding Section 1 amending ECC 3.20.050(A) and the new subparagraphs thereof is and shall be repealed and in its place enacted section to read as follows: NSS28750.1\0006.030.007 -2- 1 4 3.20.050 OCCUPATION SUBJECT TO TAX - AMOUNT A. Upon every person, firm, corporation or other entity engaged in or carrying on the business of selling or furnishing electrical energy and power, a fee or tax equal to five and one -quarter percent of the total gross income from such business within the City of Edmonds during the tax year for which the license is required; providing, however, that there shall be no tax or fee from revenues derived from the sale of electricity for the purposes of resale. Section 3. The provisions of this ordinance are legislative acts not subject to referendum. Section 1 shall be effective from and after five days from the date of posting and publication.
