Ordinance 29720006.160.120 MA/are 01/04/94 rev: 01/18/94 ORDINANCE NO. 2972 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, PROVIDING FOR THE DESTRUCTION, RETENTION, AUCTION, SALE OR TRADE OF FORFEITED FIREARMS AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, there have been recent changes to the state law provisions relating to the forfeiture of firearms, and WHEREAS, the State of Washington and its legislature allowed Cities to dispose of forfeited fire arms as determined by the City, and WHEREAS, the State of Washington and its legislature allowed Cities to destroy, retain, trade, auction or arrange for the auction of firearms after June 30, 1993, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Chapter 5.24. of the Edmonds City Code is hereby amended by adding new section 5.24.060 as follows: 5.24.060 DESTRUCTION, TRADE OR SALE OF FORFEITED FIREARMS. A. Firearms that are (i) Judicially forfeited and no longer needed for evidence; or (ii) forfeited due to a failure to make a claim under RCW 63.32.010 or 63.40.010; may be disposed of by the City of Edmonds. B. The City of Edmonds may destroy, retain, trade, auction or arrange for an auction of forfeited firearms obtained on or after June 30, 1993 pursuant to ECC 6"09.1 -1- 5.24.010(I) adopting by reference RCW 9.41.098. C. The City of Edmonds may retain the proceeds of any trade or auction of forfeited firearms. Section 2. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 3. Effective Date. This ordinance, being an administrative action, is not subject to referendum and shall take effect five (5) days after publication.
