Ordinance 29830006.160.147 TAR/nkr/srf/are 04/26/94 R:05/05/94srf R:05/18/94wss R:05/19/94wss ORDINANCE NO. 2 9 8 3 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING SECTION 8.64.030 REGARDING PROHIBITED PARKING AT ALL TIMES ON CERTAIN STREETS, SECTIONS 8.48.160 AND 8.64.060 REGARDING LIMITED PARKING ON CERTAIN STREETS, SECTIONS 8.64.045 AND 8.64.065 REGARDING TIME -LIMITED PARKING FOR CERTAIN PERIODS ON CERTAIN STREETS, AMENDING THE FINE SCHEDULE FOR PARKING VIOLATIONS IN SECTION 8.48.215 TO REFLECT AN ESCALATED FINE STRUCTURE WITH RECOMMENDED AMOUNTS, AND FIXING A TIME WHEN THE SAME SHALL BE EFFECTIVE. WHEREAS, the Downtown Parking Advisory Committee has collected a significant amount of input including input from the community regarding the revision of the downtown area parking restrictions, and WHEREAS, after much time and consideration, the Downtown Parking Advisory Committee has developed a proposal for revising the downtown parking restrictions with the goal of reducing the number of time -limited parking regulations within the downtown area from 7 to 1, making the code easier to administer, enforce, understand, provide adequate space for customer parking in the immediate downtown area and encourage employees to park in outlying free -zone areas and the ferry commuters to use public/private parking lots, and WHEREAS, on March 15, 1994, the City Council held a public hearing for public input regarding the proposal for revising the downtown parking restrictions, and 73326.50 -1- WHEREAS, as a result of the input that was provided, the City Council desires to revise the downtown area parking restrictions and impose an escalated fee schedule in order to meet the goals as outlined by the Downtown Parking Advisory Committee, and WHEREAS, in addition to review of the public streets, the Downtown Parking Advisory Committee considered City maintained lots known as the 5th Avenue South Lot and the 4th Avenue South Lot as a part of the City's overall traffic plan, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Parking Infraction Penalties. Section 8.48.215 of the Edmonds Municipal Code regarding parking infraction penalties is hereby amended to read as follows: 8.48.215 Parking Infraction Penalties. A. Any person who commits a parking infraction shall be assessed the following civil penalty, unless otherwise provided herein: 1. All parking infractions whether on public streets or within lots, except as detailed in subparagraphs 2 and 3 10.00 2. Unauthorized handicapped zone parking: 114.00 3. Parking in fire zone: 30.00 B. All persons who have committed a parking infraction and are issued a notice of infraction for violations of parking infraction ordinances except those scheduled in subparagraphs A(2) and (3) above will be assessed a reduced fine of five dollars ($5.00) for that violation if: (1) it is their first violation and; (2) the individual pays the penalty within twenty four (24) hours of the issuance of the notice of infraction. Upon committing a second violation, there shall be no opportunity for reduction and the penalty shall stand as stated in subsection A above regardless of 73326.50 -2- when the penalty is paid. After the second violation, the penalty listed above in section A shall increase by ten dollars ($10.00) increments for each subsequent violation to a maximum of thirty dollars ($30.00). Any person who remains free of parking infractions for one (1) calendar year shall revert to the base fines set forth in subparagraph A above; after the one (1) year period free of violation, an offense shall be considered as a first offense and subject to reduction as provided above if paid within twenty four (24) hours. C. All persons who have committed a parking infraction and who fail to respond to the notice of that infraction within fifteen (15) days of its issuance shall be assessed twice the civil penalty for such infraction as set forth in Subsection A of this section. Such penalty shall be in addition to any other penalties or fines imposed for failure to respond to a notice of parking infraction. Section 2. Parking Prohibited at All Times on Certain Streets. Subsection 22 of Section 8.64.030 of the Edmonds Municipal Code is hereby amended to read as follows: 8.64.030 Schedule III - Parking Prohibited at All Times On Certain Streets. 22. East side of Sunset from Bell Street to Caspers Street. Section 3. Schedule III - Parking Prohibited at All Times on Certain Streets. Subsections 28, 29, 30, and 31 are hereby created and added to Section 8.64.030 of the Edmonds Municipal Code and shall read as follows: 8.64.030 Schedule III - Parking Prohibited at All Times on Certain Streets: 28. Both sides of Dayton Street from Admiral Way to Sunset Avenue (State Route 104). 29. All three (3) sides of Centennial Plaza at Fifth Avenue and Bell Street. 73326.50 -3- 30. North side of James Street from Railroad Street to Sunset Avenue (State Route 104). 31. South side of Caspers Street from Sunset Avenue (State Route 104) to Third Avenue. Section 4. Schedule VI - Parking Limited on Certain Streets. Section 8.64.060 of the Edmonds Municipal Code is hereby amended to read as follows: In accordance with Section 8.48.160, and when signs are erected giving notice thereof, no person shall park a vehicle for a period of time longer than three hours between the hours of midnight and 6:00 p.m. of any day, except Sundays and public holidays, within the district or upon any of the streets as follows: 1. Both sides of Bell Street from Sunset Avenue North to Third Avenue North. 2. South side of Bell Street from Fifth Avenue North to Sixth Avenue North. 3. Both sides of Main Street from Sunset Avenue to Sixth Avenue. 4. Both sides of James Street from Sunset Avenue to Third Avenue South. 5. Both sides of Dayton Street from Sunset Avenue (State Route 104) to Sixth Avenue South. 6. Both sides of Second Avenue from Dayton to Caspers Street. 7. West side of Railroad Avenue from Dayton Street to Main Street. 8. Both sides of Third Avenue from Dayton to Edmonds. 9. Both sides of Fourth Avenue from Dayton Street to Bell Street. 10. North side of Bell Street from Fifth Avenue North to exit driveway from Civic Center Parking Lot. 73326.50 -4- 11. Both sides of Fifth Avenue from Walnut Street to Edmonds Street. 12. Both sides of Maple Street from Fifth Avenue South to 180 feet east of Fifth Avenue South. 13. Both sides of Alder Street from Fifth Avenue South to 180 feet east of Fifth Avenue South. 14. Both sides of Edmonds Street from Sunset Avenue to Third Avenue North. 15. West side of Sunset Avenue from Bell Street to Edmonds Street. 16. Both sides of Sunset Avenue from Main Street to Bell Street. 17. North side of Caspers Street from Sunset Avenue to Third Avenue North. 18. East side of Railroad Street from James Street to Main Street. 19. South side of James Street from Railroad Street to Sunset Avenue (State Route 104). Section 5. Parking Time Limited on Certain Streets. Section 8.48.160 of the Edmonds City Code is hereby amended to read as follows: When signs are erected in each block giving notice thereof, no person shall park a vehicle on the streets, between the hours or on the days specified in Section 8.64.060. Section 6. Schedule IV -A - Parking Time Limited For Certain Periods of Time on Certain Streets. Section 8.64.065 of the Edmonds City Code entitled "Section VI -A - Parking Time Limited For Certain Periods of Time on Certain Streets," is hereby amended by the deletion of Subsections 3, 6, 7, 9, 10, 11, 12, 13, and 14. The remaining five subsections are consecutively renumbered and Subsection 2 amended to read as follows: 73326.50 -5- 2. Westside of Sunset Avenue from Edmonds Street to Caspers Street. Section 7. Schedule IV -A - Stopping, Standing or Parking During Certain Hours On Certain Streets Prohibited. Subsection (1) of Section 8.64.045 of the Edmonds City Code is hereby deleted, and the remaining subsection 2 shall be renumbered to subsection 1. Section 8. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 9. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
